Do I need an attorney, or can I settle my own claim?

In January 2000, a court ruled that Allstate Insurance Company was performing the unauthorized practice of law, by encouraging its claims adjusters to advise claimants against hiring legal support. In one case, Janet Jones-- a claimant whose medical expenses exceeded $75,000 due to an automobile accident caused by a 17-year-old driver insured by Allstate-- was informed by the Allstate claims adjuster that $25,000 was the most she could expect to receive for her injuries. By accepting this sum, Jones was then unable to reclaim any fair compensation from the automobile manufacturer, who had produced a faulty seatbelt, or from the parents of the driver at fault.

Insurance companies know that having an attorney present can mean the difference between fair compensation for your injuries and a simple settlement. Allstate's own study, in fact, shows that the total compensation for injured individuals is four times larger when an attorney is present, than when individuals settle their cases themselves.

So when you are faced with the prospect of settling an injury claim, just remember that it may not be in your best interests to settle your case yourself. A comprehensive job performed by an attorney can show you all of your options, ensuring you receive the compensation you need to cover your medical expenses and get back on track with your life.
