Hurt in a crash in Harris County?
Harris County sits just north of Columbus, with about 35,000 people across Hamilton, Pine Mountain, Cataula, Waverly Hall, Ellerslie and the country between, and two fast roads through it, I-185 and US 27. Crashes outside the towns are worked by the Harris County Sheriff or the State Patrol. Inside Hamilton, Pine Mountain or West Point, city police usually respond.
Maybe you were on US 27 near Cataula, headed home from work in Columbus, and a driver pulled out of a side road without looking. Maybe you were on the curves of SR 190 near Pine Mountain on a Saturday with the Callaway Gardens traffic and a car crossed the center line. Maybe you were on I-185 north of the county line, where the road opens up and people drive like it. Now you’re sore, the truck is at a body shop in Columbus, and an adjuster wants a statement before you’ve seen a doctor.
Kenneth S. Nugent, P.C. has represented injured Georgians since 1980, and our office in Uptown Columbus is twenty minutes down I-185 from Hamilton. This page covers who has your report, what changes when a city or the county is involved, why Harris County roads produce the crashes they do, and how long you have. The consultation is free, and there’s zero fee unless we win.
Don’t sign anything an insurance company sends you, and don’t give a recorded statement, before you’ve talked with an attorney.
Who has your crash report in Harris County?
The Harris County Sheriff’s Office in Hamilton keeps crash reports for wrecks on county roads and the open stretches of US 27 and I-185. The State Patrol post in LaGrange covers Harris County and works many serious highway crashes. Hamilton, Pine Mountain and West Point have their own police, and a crash inside those city limits usually belongs to them.
| Where it happened | Who usually responds | Where to ask for the report |
|---|---|---|
| I-185 from the Muscogee County line north past Smith Road and the Pine Mountain exits | Georgia State Patrol or Harris County deputies | State Patrol Post 2, 1659 Lafayette Parkway in LaGrange, or the state’s online crash report service |
| US 27 through Cataula, Hamilton and Pine Mountain, outside the city limits | Harris County Sheriff or the State Patrol | Harris County Sheriff’s Office in Hamilton |
| Inside Hamilton, Pine Mountain or West Point | City police | The city police department, with your report number |
| SR 315, SR 116, SR 85 toward Waverly Hall, SR 18 and the county roads | Harris County Sheriff | Harris County Sheriff’s Office in Hamilton |
| Across the river on the Lake Harding bridges | Alabama troopers or Lee County deputies | An Alabama agency, and an Alabama case with different rules |
Harris County has no hospital. Serious crash victims go to Piedmont Columbus Regional or St. Francis-Emory in Columbus, or to the hospital in LaGrange, and the report is often written after the ambulance has left. Get the report number from the deputy or trooper, or call the agency the next day with the date and the road. If nobody came, which happens on minor wrecks out in the county, file a report yourself.
Georgia limits who can get a crash report to the people named in it, their lawyers and their insurers. A family member can usually pick one up for you if you’re still recovering.
What makes Harris County crashes different?
Harris County is where Columbus commuters meet rural roads. US 27 carries people between Columbus and Hamilton at highway speed past side roads with no signal, and I-185 north of the county line is open and fast. Pine Mountain adds weekend traffic on curving two-lane roads. Most serious crashes here are head-on, run-off-road or a pull-out from a side road.
| The kind of crash | Where it happens here | How fault usually works |
|---|---|---|
| Pull-out from a side road or driveway | US 27 at the crossroads in Cataula and the side roads into the subdivisions north of Columbus | The driver entering the highway usually has to yield. A through driver who was speeding shares the blame. |
| Head-on on a two-lane road | SR 190 and SR 354 around Pine Mountain, SR 116 and SR 315 across the county | The driver who crossed the center line is at fault. Proving which one did can turn on the physical evidence and the State Patrol’s reconstruction. |
| Run-off-road, single vehicle | I-185 at night, the curves near the state park | A road defect, a missing guardrail or a work zone can make the state or county responsible. These deadlines are short. |
| Deer and livestock | Every road in the county after dark | A deer strike is usually a claim on your own policy. Livestock on the road can be the owner’s responsibility. |
| Rear-end in the Columbus commute | US 27 and I-185 where traffic backs up toward the county line | The driver who hit from behind is usually at fault. Following too closely is the reason, not an excuse. |
Rural crashes have a problem city crashes don’t. There is often no witness, no camera and a long wait for the ambulance. The State Patrol’s reconstruction, the skid marks and the damage to both vehicles carry more weight than they would on Manchester Expressway, and the insurer knows it. Photographs taken before the vehicles are moved can be the difference in a disputed head-on.
How long do you have after a Harris County crash?
If another driver hurt you, Georgia gives you two years to file suit. If Harris County caused the crash through a county vehicle or road, written notice is due within twelve months. If Hamilton, Pine Mountain or West Point was responsible, it is due within six. A claim about US 27 or I-185 itself is against the state, twelve months.
| Who caused the harm | Deadline | Georgia law |
|---|---|---|
| Another driver, a business or a trucking company | 2 years to file a lawsuit | O.C.G.A. § 9-3-33 |
| Harris County: a county vehicle, a deputy on duty, a county road or bridge | 12 months to send written notice | O.C.G.A. § 36-11-1 |
| The City of Hamilton, Pine Mountain, Waverly Hall, Shiloh or West Point: a city vehicle, a city employee, a city street | 6 months to send written notice | O.C.G.A. § 36-33-5 |
| The State of Georgia: a state vehicle, or the design or upkeep of US 27, I-185 or a state route | 12 months to send written notice | O.C.G.A. § 50-21-26 |
Harris County is simpler than Columbus on this point. Columbus and Muscogee County are one consolidated government, and whether the six-month city rule or the twelve-month county rule applies there is unsettled. Harris County is a plain county, with twelve months, and its towns are plain cities, with six. Which one you are dealing with depends on whose vehicle, whose employee or whose road was involved, and that is the first thing we check.
The notice is not a lawsuit. It is a letter that tells the government when and where the crash happened, what the harm was and roughly what you’re asking for, sent the right way to the right office. Getting it wrong can cost you the claim.

Which court hears a Harris County injury case?
An injury lawsuit from a Harris County crash is usually filed in the State Court or Superior Court of Harris County at the courthouse in Hamilton, part of the Chattahoochee Judicial Circuit, the same circuit as Columbus. A case against an out-of-state trucking company can sometimes move to federal court in Columbus. Most claims settle before anyone files.
Where a case is filed shapes who decides it. A Harris County jury is drawn from Hamilton, Pine Mountain, Cataula and the farms between, and they know these roads. A case built on the report, the reconstruction and the medical records lets them see what happened.
What this means for your claim
A Harris County crash is usually a claim against another driver’s insurance, decided by evidence that is harder to come by than in the city. The State Patrol’s report, your own photographs and the first medical record carry the case. If a city, the county or the state is in the picture at all, the clock is short and the letter has to be right.
For a wreck between two vehicles, see car accident claims near Columbus. If a tractor-trailer on I-185 or US 27 was involved, tractor-trailer crash claims in Georgia explains why those cases move differently, and truck crashes on I-185 covers the interstate from the Columbus side. If the injuries were severe, brain injury claims after a crash and wrongful death claims cover those cases. Once you reach the city, wrecks on Manchester Expressway and Macon Road covers the roads into north Columbus.
What should you do this week?
- Get checked out, even if the ambulance didn’t take you. Piedmont Columbus Regional, St. Francis-Emory and the hospital in LaGrange all see Harris County crash patients, and the first record is the one insurers read.
- Find out which agency wrote the report, the Sheriff, the State Patrol or a city department, and get the report number.
- Photograph both vehicles and the road before anything is moved or repaired. Out here the pictures often are the evidence.
- Write down the road, the nearest crossroads, your direction and whether a county, city or state vehicle was involved.
- Call 706-807-8232 and talk with the Columbus attorneys who handle Harris County crashes. Don’t give a recorded statement or sign anything first.
Our Columbus office is at 1234 First Avenue, Suite 200, about twenty minutes from Hamilton by I-185. The consultation is free, you pay nothing up front, and there’s zero fee unless we win.
What do these terms mean?
- Ante litem notice. A written notice you must send to a city, a county or the state before you can sue it. The Latin means “before the lawsuit.”
- Crash reconstruction. The State Patrol’s detailed study of a serious crash, using skid marks, damage and the vehicles’ data to work out speeds and positions.
- Consolidated government. A city and a county merged into one, like Columbus and Muscogee County. Harris County is not one.
- Uninsured motorist coverage. Part of your own auto policy that pays when the driver who hit you had no insurance or fled.
- Crash report custodian. The agency that keeps the official report, and the one you ask for a copy.
