Georgia Car Accident Lawyer
Hurt in a Georgia crash? Know your deadlines before you sign anything — including the six-month rule if a city vehicle was involved. Zero fee until we win.
Most people we talk to call from a parking lot, or a hospital hallway, or their own kitchen table a day later — when the shaking has stopped and the questions have started. The car is somewhere on a wrecker lot. Someone from an insurance company has already left a voicemail. And nobody has explained what any of it means.
That is the part we can take off your hands.
Before you give a recorded statement or sign anything from the insurance company, talk to us first. A signed release or an early recorded statement can quietly close doors you did not know were open.
What Should You Do First After a Car Accident in Georgia?
In the first hours after a Georgia car accident, three things matter most: get medical attention even if you feel fine, make sure a police report is created, and say nothing to the other driver’s insurance company until you have talked to a lawyer. Photographs, witness names, and the responding officer’s information are far easier to gather now than to reconstruct later.
The instinct to be helpful is the one that costs people money. An adjuster who calls the day after a wreck is friendly, sympathetic, and recording. You are not required to give the other driver’s insurer a recorded statement, and you are allowed to say that your attorney will be in touch.
How Long Do You Have to File a Car Accident Claim in Georgia?
Georgia generally gives you two years from the date of the injury to file a personal injury lawsuit. But that single number hides several deadlines that are shorter, longer, or run on a different clock entirely — and the shortest of them can expire before most people have finished physical therapy.
Suing a City, County, or the State: The Shorter Clock
If a government vehicle was involved, ordinary deadlines do not apply. Before you can sue at all, you must send a written notice called an ante litem notice. “Ante litem” simply means “before the lawsuit.” Miss it, and the case is generally over regardless of how badly you were hurt.
| Who caused the harm | Notice deadline | Clock starts |
|---|---|---|
| City or municipal corporation | 6 months | The date of the event |
| County | 12 months | When the claim accrues |
| State of Georgia or a state agency | 12 months | When the loss was, or should have been, discovered |
The six-month city deadline is the one that catches people. Cities are not on the twelve-month clock — they are on six months, and it runs from the event itself rather than from when you discovered the harm.
Which Insurance Actually Pays After a Georgia Crash?
| Coverage layer | What it does |
|---|---|
| At-fault driver’s liability | Pays your damages up to their policy limit |
| Your uninsured/underinsured motorist (UM/UIM) | Steps in when they have no coverage, not enough, or fled |
| Your medical payments coverage | Pays medical bills regardless of fault |
| Additional policies | A commercial, employer’s, or household policy may apply |
Add-On vs Reduced-By UM: Why the Difference Can Be Everything
Add-on UM stacks on top of the at-fault driver’s coverage. Reduced-by UM pays only the gap. And add-on is Georgia’s default — reduced-by has to be affirmatively chosen. Most people have never been told which one they bought, and it can be the difference between a claim that covers the surgery and one that does not.

Nothing up front, and nothing at all until we win. Every client gets an attorney’s direct number from the first day — which is how a firm handles 300,000+ cases without becoming a call center. Nine Georgia offices. Someone answers the phone at any hour, because wrecks do not keep business hours.
Do not sign anything from an insurance company before you talk to a lawyer. Not a release, not a settlement offer, not a medical authorization.
