Hit by a truck on the Athens Perimeter?

The Athens Perimeter, signed as Loop 10, is a nineteen-mile freeway that carries US 29, US 78, US 129 and US 441 on its busiest stretch. Crashes are worked by Athens-Clarke County Police, the Oconee County Sheriff on the southwest segment, and the State Patrol on serious ones. A truck crash adds federal rules and a bigger insurance policy.

Maybe you were merging onto the inner loop at College Station Road when a tractor-trailer drifted into your lane. Maybe you were stopped in the backup at the Lexington Road exit and a truck never slowed. Now the car is gone, your neck and back hurt more every morning, and someone from the trucking company’s insurer has already left a friendly voicemail.

Kenneth S. Nugent, P.C. has handled truck crash claims across Georgia since 1980, and our Athens office on South Milledge Avenue is just inside the loop at the Milledge Avenue exit. This page covers who has your report, why truck crashes on the Perimeter are different from car crashes, what evidence disappears first, and how long you have. The consultation is free, and there’s zero fee unless we win.

Don’t sign anything from a trucking company or its insurer, and don’t give a recorded statement, before you’ve talked with an attorney.

Who has your crash report from Loop 10?

Most of the Athens Perimeter is in Clarke County, so Athens-Clarke County Police write most Loop 10 crash reports. The southwest end, from the SR 316 interchange past Epps Bridge Parkway, is in Oconee County and belongs to the Sheriff there. The State Patrol works many serious crashes on the loop and on US 441 and US 29.

A truck crash report is longer than a car crash report. Georgia’s form has a commercial vehicle section that records the carrier’s name, its federal motor carrier number, whether the driver was tested, and whether the truck was inspected after the crash. Ask for the full report, not the one-page summary, and ask whether the State Patrol’s specialized crash team was called. If it was, there is a second, far more detailed report coming.

Georgia limits who can get a crash report to the people named in it, their lawyers and their insurers. The trucking company’s insurer will have the report within a day or two. You should have it just as fast.

Why are truck crashes on the Perimeter different?

A loaded tractor-trailer can weigh twenty times what your car weighs and needs a football field or more to stop at highway speed. On the Perimeter, where four US routes squeeze onto one freeway and exits come every mile, a truck following too closely has no room to recover. The driver and the company both answer to federal safety rules.

What makes it differentHow it worksWhy it matters for your claim
Federal rulesInterstate trucking is governed by federal safety regulations covering driver hours, vehicle inspection, drug and alcohol testing and driver qualificationA rule violation found after the crash, such as a driver past his hours limit, is strong evidence of fault
Electronic logsMost trucks record driving time electronically, and many carry forward-facing cameras and event recordersThis data can be overwritten in days unless someone demands it be kept
Bigger insuranceInterstate carriers must carry far more liability coverage than a private driver, generally starting at $750,000 and higher for hazardous loadsThere is usually enough coverage for a serious injury, which is exactly why the insurer fights harder
More than one defendantThe driver, the trucking company, the owner of the trailer, the shipper that loaded it and a maintenance contractor can each share faultGeorgia lets you bring them into one case, and in many trucking cases name the insurer directly
A rapid response teamLarge carriers send investigators and lawyers to serious crashes within hoursThey are building the company’s defense while you are still in the emergency room

The Perimeter has its own trouble spots. The stretch from Timothy Road to Lexington Road carries the heaviest traffic, with every US route through Athens stacked on it. The Lexington Road interchange has been under reconstruction, and work zones with shifting lanes are where trucks and cars collide most. College Station Road fills with game day traffic several Saturdays a year, and the Commerce Road exit is where northbound trucks leave for the interstate.

Serious crashes here are not rare. In December 2025 a wrong-way driver on the inner loop near Chase Street struck three vehicles and killed two people, the eighth fatal crash in the county that year. In June 2026 a motorcyclist died on the inner loop between the US 441 and Epps Bridge Parkway exits. Neither involved a truck, but both show the speed and the traffic the Perimeter carries.

What evidence disappears first after a truck crash?

The electronic log, the event recorder, the dashcam footage, the hours records and the post-crash inspection decide a truck case, and none of it belongs to you. The carrier controls it, and federal rules only require some of it to be kept for months. A written demand to preserve it, sent within days, is the first thing we do.

  • Event recorder data. Speed, braking and steering in the seconds before impact. It can be overwritten the next time the truck is driven.
  • Dashcam and in-cab video. Many fleets keep it only for days unless a claim is flagged.
  • Hours-of-service logs. Federal rules require carriers to keep them for about six months. After that they’re gone.
  • The truck itself. Brakes, tires and the trailer coupling. A carrier can repair or sell a truck before anyone inspects it.
  • Dispatch records and bills of lading. They show how far the driver had come, how the load was secured and how tight the schedule was.
  • Traffic cameras and nearby business video. The state and county cameras along the loop and the businesses at the exits usually overwrite within a week.

How long do you have after a Loop 10 truck crash?

A claim against a truck driver and trucking company carries Georgia’s two-year deadline to file a lawsuit. If a state vehicle or the road itself, such as a Perimeter work zone, is involved, written notice to the state is due within twelve months. A county vehicle or county road means a shorter clock, treated as six months here.

Who caused the harmDeadlineGeorgia law
A truck driver, a trucking company or another private driver2 years to file a lawsuitO.C.G.A. § 9-3-33
The State of Georgia: a state vehicle, or the design or maintenance of Loop 10, US 441 or US 2912 months to send written noticeO.C.G.A. § 50-21-26
Athens-Clarke County Unified Government: a county vehicle, a county road at an exitTreat as 6 months to send written noticeO.C.G.A. § 36-33-5 or § 36-11-1
Oconee County: a county vehicle or county road on the southwest segment12 months to send written noticeO.C.G.A. § 36-11-1

Two years sounds like plenty. In a truck case it is not, because the evidence that proves the claim is in the carrier’s hands and starts disappearing in days. The deadline to file is the last date, not the date to start.

Which court hears a Perimeter truck case?

A truck crash lawsuit from the Clarke County portion of the Perimeter is usually filed in the State Court of Clarke County or in Superior Court at the courthouse in Athens. A crash on the Oconee County segment may be filed in Watkinsville. A trucking company based out of state can sometimes move the case to federal court in Athens.

Where the case is filed shapes how it moves and who decides it. Out-of-state carriers often prefer federal court. The choice is one of the first strategic decisions in a truck case, and it belongs to you and your lawyer, not the carrier.

What this means for your claim

A truck crash on the Perimeter is a claim with more money behind it and more people fighting over it than a car crash. The carrier’s insurer will move fast, sound reasonable and ask you to sign a release before you know what your injuries are. The right answer to that is no, every time, and a call to someone who handles these cases.

Our page on tractor-trailer accident claims in Georgia goes deeper on the federal rules and how fault is proven. For a wreck with a car rather than a truck, see car accident claims on the Athens Perimeter. If the injuries were severe, brain injury claims after a highway crash and wrongful death claims in Georgia explain what those cases involve. Crashes on the surface streets inside the loop are covered on crashes around the UGA campus and drunk driving and rideshare crashes downtown.

What should you do this week?

  1. Get checked out. Piedmont Athens Regional and St. Mary’s are both minutes from the loop, and a truck crash injury often gets worse before it gets better.
  2. Get the full crash report, with the commercial vehicle section, and note the carrier’s name and federal motor carrier number.
  3. Photograph your car before it’s moved or repaired, and keep every piece of paper from the tow yard.
  4. Write down the exit you were near, your direction, the lane you were in and what the truck did.
  5. Call 706-807-1711 and talk with the Athens attorneys who handle Perimeter truck crashes. Don’t give a recorded statement or sign anything first.

Our Athens office is at 394 South Milledge Avenue, inside the loop at the Milledge Avenue exit. The consultation is free, you pay nothing up front, and there’s zero fee unless we win.

What do these terms mean?

  • Motor carrier. The trucking company. It is responsible for its drivers and its trucks, and it carries the insurance.
  • Hours of service. Federal limits on how long a truck driver can drive and work before resting. Violations are common in crash cases.
  • Event data recorder. The truck’s electronic record of speed, braking and other data in the seconds before a crash.
  • Spoliation letter. A written demand that the carrier preserve evidence. Destroying evidence after receiving one can be held against the company in court.
  • Direct action. Georgia’s rule that lets an injured person name a trucking company’s insurer as a defendant in some cases.
  • Ante litem notice. A written notice you must send to a city, a county or the state before you can sue it. The Latin means “before the lawsuit.”
