The county line runs through Buford, and your case follows the line
Buford is one city sitting in two counties. Most of it is Gwinnett. The northern end, above the line that runs roughly along the older part of town toward Lake Lanier, is Hall County. People who have lived here their whole lives do not always know which side of that line their house is on, and it almost never matters. After a crash it matters a great deal. The county decides which courthouse your lawsuit goes to, which sheriff and which county police may have worked the scene, and which of two different notice deadlines applies if a government vehicle or a government road was involved.
Kenneth S. Nugent, P.C. works both sides. Our Duluth office runs up Buford Drive to handle the Gwinnett cases, and the firm has been filing in Hall County for decades out of our reach into northeast Georgia. Across the state we have recovered more than $5 billion for over 300,000 clients in 45 years, from 9 offices. The first question we ask a Buford caller is not what happened. It is where, exactly.
Don’t sign anything from the insurance company before speaking with an attorney. Their first offer is almost never their best.
Which county were you in, and who worked the crash
Buford Police cover crashes inside the city limits on both the Gwinnett and the Hall side, so the responding agency does not always tell you which county you were in. Outside the limits, Gwinnett County Police work the southern approaches and Hall County deputies work the northern ones. Georgia State Patrol works some of the serious wrecks on I-985 and GA-20. The responding agency is usually the first place to request the report, and the officer’s information card names it along with the report number.
| Where the crash happened | Who usually responds | Which county governs |
|---|---|---|
| Inside Buford city limits, Gwinnett side (Mall of Georgia area, Buford Dr, most of the city) | Buford Police Department | Gwinnett County |
| Inside Buford city limits, Hall side (north end toward Lake Lanier) | Buford Police Department | Hall County |
| Unincorporated Gwinnett around the city | Gwinnett County Police Department | Gwinnett County |
| Unincorporated Hall County to the north | Hall County Sheriff’s Office | Hall County |
| I-985 and GA-20 when a trooper responds | Georgia State Patrol | Depends on the mile marker |
The practical version: a wreck at the Mall of Georgia and a wreck near the Lake Lanier islands are a few miles apart and can end up in different courthouses, with different judges and different timelines. Most Buford lawsuits on the Gwinnett side are filed in the State Court of Gwinnett County, at the Justice and Administration Center in Lawrenceville. On the Hall side they generally go to Hall County in Gainesville. We work out which applies before we send a single letter.
What we handle for Buford families
Car, truck, and motorcycle crashes. Buford Drive and GA-20 carry mall traffic, commuter traffic, and freight all at once, and I-985 puts interstate speed a minute away from both. Our Georgia car accident lawyers handle the ordinary rear-end in the mall ring road and the high-speed wreck on 985 the same way: report, medical bills, adjuster, claim. Free consultation, available any hour, zero fee unless we win. The distribution centers along the 985 corridor put a lot of tractor-trailers on these roads, and when one is involved our truck accident lawyers get a preservation letter to the carrier early, since some fleet records may be overwritten on short retention cycles. Riders on GA-20 and the roads around the lake go to our motorcycle accident lawyers, and anyone hit by an impaired driver, which rises around the lake in summer, should read what our drunk driving accident lawyers say about punitive damages.
Falls, dog bites, and injuries at work. The Mall of Georgia and the shopping centers around it are the largest retail complex in this part of the state, and they generate the ordinary run of parking deck, entryway, and spill cases. Our Georgia slip and fall lawyers work out who owned the hazard and how long they knew about it, which in a complex with multiple owners and a management company is rarely as simple as it sounds. Dog bites turn on the animal control record for whichever county you were in, and the leash ordinance that applies there, which is where our dog bite lawyers start. Buford has warehouse and distribution employment on both sides of the line, and Georgia workers’ compensation has its own rules, deadlines, and doctor list. Our workers’ compensation lawyers can tell you which apply to your job.
Catastrophic injuries and deaths. Brain and spinal injuries, and wrongful death claims, are staffed differently from the first day, with medical specialists and life care planners brought in early. Our traumatic brain injury lawyers, wrongful death lawyers, and medical malpractice lawyers explain those cases on their own pages, including the affidavit rule that makes a malpractice claim different from every other kind.
Three places Buford cases come from
The Mall of Georgia corridor. Buford Drive between I-85 and the mall, with its ring roads and parking decks, is the densest crash area in the city and sits almost entirely on the Gwinnett side. The wrecks here are low speed and high volume: left turns across traffic, backing collisions in the decks, pedestrians walking between rows. Low speed does not mean minor, particularly for necks, backs, and older drivers.
I-985 and GA-20. The interstate and the state route feeding it produce the serious ones, with speed, trucks, and drivers who are not from here looking for an exit. A crash on 985 can cross the county line depending on the mile marker, one more reason the exact location matters.
Lake Lanier and the roads around it. In summer the north end of Buford fills with boat trailers and visitors who do not know the roads. Injuries on the water are a different kind of case, with different rules about who was operating and what insurance applies, and most of that sits on the Hall County side. Tell us early if the lake was involved, because it changes whose records we ask for.
Across all three, the evidence that decides the case is often on a camera facing the road, at the mall, the fuel stops along 985, or a business on GA-20. That footage may be overwritten on short retention cycles, sometimes within days, so we send preservation requests in the first week.
Deadlines that change depending on which side you were on
Two years is the general rule for filing a Georgia injury lawsuit. When a government caused the harm, a much shorter written notice is required first, called an ante litem notice, and it has to go to the right government, at the right address, in the way the statute requires. In a city that sits in two counties, getting the right government is the whole problem. A crash with a county vehicle three miles apart can mean Gwinnett or Hall, and the notice goes to a different place for each.
| Who caused the harm | Deadline to send notice | Georgia law |
|---|---|---|
| The City of Buford (city streets, city vehicles, city property, either side of the line) | 6 months | O.C.G.A. § 36-33-5 |
| Gwinnett County (county roads and vehicles on the Gwinnett side) | 12 months | O.C.G.A. § 36-11-1 |
| Hall County (county roads and vehicles on the Hall side) | 12 months | O.C.G.A. § 36-11-1 |
| The State of Georgia or GDOT (I-985, GA-20, GA-13 Buford Hwy) | Generally 12 months, with specific delivery rules | O.C.G.A. § 50-21-26 |
| A private driver or business | 2 years to file suit | O.C.G.A. § 9-3-33 |
I-985 and GA-20 are state routes, so a claim about the road itself, a signal, a shoulder, an interchange people have complained about for years, is a claim against the state, on the state’s clock and with the state’s delivery rules. That is a separate letter from the one that goes to the driver’s insurance company. We send both, and we send them early, because the six-month city clock is the one that catches people.
Where they take you, and what to keep from those first days
Which hospital you wake up in depends on the same line. Serious crashes on the Gwinnett side usually go to Northside Hospital Gwinnett in Lawrenceville. On the Hall side and around the lake, Northeast Georgia Medical Center in Gainesville is closer and is where many of those patients are taken. Either way, keep every discharge sheet and every imaging disc, and ask for the responding agency and report number from the paperwork the emergency room kept.
If you were treated and released the same day, see your own doctor within a day or two anyway. Concussion and soft-tissue symptoms often surface once the adrenaline wears off, and an adjuster will read a two-week gap in the record as evidence that nothing was wrong. And do not give a recorded statement to any insurance company from a hospital bed, including your own. You can be polite and still say you will call them back.
