AFTER THE ACCIDENT

It happened on the way to practice, or on the way home

Suwanee is a town of ball fields, cul-de-sacs, and one very busy stretch of Peachtree Industrial. Most of the crashes we see from here happen in the ordinary middle of the day: the left turn off Lawrenceville-Suwanee Road, the merge at I-85 exit 111, the light at Buford Highway and Suwanee Dam Road with three kids in the back. Now you have a sore neck, a car you cannot drive, and a voicemail from an adjuster who sounds friendlier than he should.

Don’t call him back yet. Kenneth S. Nugent, P.C. has handled Suwanee cases from our Duluth office on Pleasant Hill Road for more than twenty-five years. Peachtree Industrial takes you door to door in about fifteen minutes. Across Georgia we’ve recovered more than $5 billion for over 300,000 clients in 45 years, from 9 offices.

Suwanee is a Gwinnett County city with its own police department and its own municipal court, and a lot of the land around it, especially south toward Duluth and east along Lawrenceville-Suwanee Road, is unincorporated county. Which side of that line your crash fell on decides who has your report and how long you have to act. We sort that out on the first call.

Don’t sign anything from the insurance company before speaking with an attorney. Their first offer is almost never their best.

Car and truck accidents in Suwanee

Most Suwanee injury cases start on Peachtree Industrial Boulevard, Buford Highway, Lawrenceville-Suwanee Road, or the I-85 interchange at exit 111. Our Georgia car accident lawyers handle these cases from the first call: the report, the medical bills, the adjuster, and the claim. Free consultation, available 24 hours a day, no fee unless we win.

I-85 through Suwanee carries some of the heaviest truck traffic in north Georgia, and the exits at Lawrenceville-Suwanee Road and Old Peachtree Road put tractor-trailers and school traffic on the same ramps. When a commercial truck is involved, the case changes. The company’s driver logs can be destroyed after six months, so our truck accident lawyers send a preservation letter early, before the evidence quietly disappears.

If you were on a motorcycle on Buford Highway, or on foot near Town Center or Suwanee Creek Park, the first question you will be asked is about your helmet or the crosswalk, not about what the driver did. Our motorcycle accident lawyers and pedestrian accident lawyers know how to answer that question so it does not decide your case. A rideshare crash on the way home from Town Center is a different puzzle again, and our Uber and Lyft accident lawyers can tell you which insurance policy was actually on the hook.

Falls, dog bites and workplace injuries in Suwanee

A fall on a wet grocery store floor, a parking lot with no lighting, or an apartment stairwell that was never fixed is a claim against the property owner when they knew and did nothing. Our Georgia slip and fall lawyers take these cases across Suwanee, from the shopping centers along Peachtree Industrial to the apartment communities off Satellite Boulevard. You pay nothing up front and no fee unless we win.

Suwanee is a dog town, with trails, a dog park at George Pierce Park, and a yard on nearly every lot. Georgia is not a strict liability state, so a local leash ordinance can decide the case. Our dog bite lawyers know how to use it. And if you were hurt at work, in one of the distribution centers along the interstate or on a residential job site, our workers’ compensation lawyers can tell you whether you have one claim or two.

Serious injuries and wrongful death

Some crashes change everything. A brain injury that a clean CT scan missed. A spinal injury that means a different house and a different job. The loss of a parent or a child. Our traumatic brain injury lawyers and wrongful death lawyers bring in medical specialists and life care planners early, because the value of a case like this is decided by what the future costs, not what the bills say today.

If the harm happened inside a hospital or a doctor’s office rather than on the road, that is a different kind of case with its own affidavit requirement and its own deadlines. Our medical malpractice lawyers can tell you within one call whether what happened to you is worth looking at.

How long do you have to file a claim in Suwanee?

Most Georgia injury claims must be filed within two years. But if a city, county, or state agency is responsible, you must send a written notice long before that. Inside the City of Suwanee that notice is due in six months. On unincorporated Gwinnett land, or on a state route, it is twelve. The clock starts the day of the crash.

That notice is called an ante litem notice. It is Latin for “before the lawsuit,” and that is exactly what it is: a formal letter you have to send to the government before you are allowed to sue it. Miss the window and the claim is gone, no matter how badly you were hurt.

Who caused the harmDeadline to send noticeGeorgia law

A private driver or business2 years to file suitO.C.G.A. § 9-3-33

Here is the Suwanee twist. Lawrenceville-Suwanee Road leaves the city limits before it reaches the interstate, and Peachtree Industrial goes in and out of the city more than once between Sugar Hill and Duluth. You can cross that line without noticing. But the deadline on your claim changes when you do, and so does who you send the letter to.

If a government vehicle or a road hazard was involved, call us this week if you can. Not because we want to rush you. Six months just goes faster than it sounds when you are in physical therapy.

Which court hears your case, and who has your crash report?

A Suwanee injury case is filed in the State Court of Gwinnett County in Lawrenceville, about twenty minutes down Lawrenceville-Suwanee Road. Your crash report is held by Suwanee Police if the crash was inside the city, by Gwinnett County Police if it was on unincorporated land, and by the Georgia State Patrol if a trooper worked it on I-85.

Gwinnett is one of the Georgia counties that has both a State Court and a Superior Court. State Court handles civil cases like personal injury and generally moves faster. Superior Court handles those plus felonies, divorces, and land disputes. Both sit at the Gwinnett Justice and Administration Center in Lawrenceville. A traffic citation from the crash goes to the Municipal Court of Suwanee, which is a separate building and a separate case.

You can request the report yourself, and you should if you are able. If you would rather not chase it, tell us where the crash happened and we will pull it. The officer’s diagram, the citation, and the listed witnesses usually decide how an insurance company values your claim before anyone says the word settlement.
