DOWNTOWN VALDOSTA · REMERTON · DUI & RIDESHARE

Hit by a drunk driver or hurt in a rideshare in Valdosta or Remerton?

Downtown Valdosta is worked by Valdosta Police. Remerton, the small city inside Valdosta where the bar strip sits along Baytree Road, has its own police and its own six-month deadline for claims against it. If the driver was drunk, or you were in an Uber or Lyft, the insurance picture changes, and so does what your claim is worth.

Maybe you were walking from a bar in Remerton back to an apartment off Baytree Road at one in the morning when a driver never saw the crosswalk. Maybe you were a passenger in a rideshare on Hill Avenue and the car behind you never braked. Or maybe you did everything right, left the car at home and called a ride, and still ended up in the emergency room at South Georgia Medical Center.

Kenneth S. Nugent, P.C. has handled drunk driving and rideshare injury claims across Georgia since 1980, and our Valdosta office is a few minutes from downtown and from Remerton. This page covers who has your report, what a drunk driver changes about your claim, how rideshare insurance works in Georgia, and how long you have. The consultation is free, and there’s zero fee unless we win.

Don’t sign anything from an insurance company, and don’t give a recorded statement, before you’ve talked with an attorney.

Who has your crash report from downtown or Remerton?

Valdosta Police keep crash reports for downtown, Hill Avenue, Patterson, Ashley and the rest of the city. Remerton Police keep reports for crashes inside Remerton, which covers the Baytree Road bar strip and the blocks around it. The line between the cities is not marked on the street, so the officer’s card is the only sure way to know.

Where it happenedWho usually respondsWhere to ask for the report
Downtown Valdosta: Patterson, Ashley, Hill Avenue, Central Avenue and the blocks around the courthouseValdosta PoliceValdosta Police records, or the online crash report service the department uses
Inside Remerton: the bar strip on Baytree Road and the surrounding blocksRemerton PoliceRemerton Police, with your report number

Past the city limits on US 84 or North Valdosta RoadLowndes County Sheriff or the Georgia State PatrolLowndes County Sheriff’s Office, or State Patrol Post 31
A parking lot at a bar, a restaurant or an apartment complexWhichever department covers that address, if they come at allThat department, as a private property report. If no officer came, file one yourself.

Ask for the report even if the driver was arrested. A DUI arrest starts a separate criminal case, and the crash report, the officer’s narrative and any body camera footage are what an injury claim is built on. The criminal case can take a year. Your claim does not have to wait for it.

Georgia limits who can get a crash report to the people named in it, their lawyers and their insurers. If you were a passenger, you’re named. If you were on foot and the driver left, you may need the report number from the officer who took your statement at the hospital.

What does a drunk driver change about your claim?

In Georgia a drunk driver’s crash is still a negligence claim, but the drinking opens two doors. A jury can award punitive damages to punish the driver, and the cap that usually limits those damages generally does not apply to an impaired driver. A bar that kept serving a visibly drunk person about to drive may share the blame.

QuestionHow it usually works in GeorgiaWhy it matters here
Can the driver be made to pay more because they were drunk?Yes. Georgia allows punitive damages, meant to punish rather than repay, and the cap that limits them in most cases generally does not apply to a driver impaired by alcohol or drugs. O.C.G.A. § 51-12-5.1.Remerton packs most of the area’s bars into a few blocks, and the students and airmen who fill them mostly drive in from Valdosta.
Can the bar be held responsible?Sometimes. Georgia’s dram shop law lets an injured person sue a business that served someone who was noticeably intoxicated and who the business knew would soon be driving. O.C.G.A. § 51-1-40.Remerton moved its bar closing time to 1 a.m. in 2025 and added cameras and foot patrols on the strip. That video is evidence, and it does not keep itself.
Does the DUI conviction prove my case?It helps, but a guilty plea and a crash are two different questions. A driver can be convicted of DUI and still argue the crash was partly your fault.Expect the driver’s insurer to look hard at whether you were crossing mid-block or had been drinking yourself.
What if the driver ran?A hit and run with no identified driver usually becomes a claim on your own uninsured motorist coverage, or a parent’s policy if you’re a student on theirs. The strip’s cameras and the apartment complexes along Baytree Road are the first places to ask.

Georgia’s comparative fault rule cuts your recovery by your share of the blame and bars it entirely if you were half or more at fault. Drunk driving cases are where insurers lean on that rule hardest against pedestrians. Someone who had two drinks and crossed Baytree Road mid-block still has a claim against a driver who was over the limit, but the insurer will try to make the case about the pedestrian. Don’t help them with a recorded statement.

One more thing about Remerton. It is a separate city, with its own council, its own police and its own six-month deadline for claims against it. A fall on a broken Remerton sidewalk or a crash with a Remerton city vehicle is a claim against Remerton, not Valdosta, and the notice has to go to the right city hall.

How does rideshare insurance work after a Valdosta crash?

Georgia requires rideshare companies to carry at least one million dollars in liability coverage from the moment a driver accepts a ride to the moment the passenger gets out. A smaller policy applies while the app is on and the driver is waiting. With the app off, only the driver’s personal auto policy applies, and most exclude commercial driving.

What the driver was doingWhose insurance usually appliesWhat that means for you
App offThe driver’s own auto policy, if it doesn’t exclude rideshare useTreat it as an ordinary car crash. The rideshare company will say it isn’t involved.
App on, waiting for a requestA smaller rideshare policy, with lower limits than during a rideEnough for a modest claim. Often not enough for a hospital stay.
Ride accepted, driving to the pickupThe rideshare company’s one million dollar policyCovers you whether you were the passenger, in another car or on foot
Passenger in the carThe one million dollar policy, plus uninsured motorist coverage at the same level if another driver caused itThe strongest position a rideshare passenger can be in. Save the trip receipt.

The trip record settles most arguments about which row you’re in. Your app shows the pickup point, the route and when the ride ended. Screenshot it before it drops out of your history, and don’t delete the app. If you were hit by a rideshare car while walking, we can get the driver’s status from the company, but it takes a formal request and the company will not volunteer it.

Rideshare drivers in Valdosta are often students and airmen driving between shifts, in their own cars, on streets they know well. That familiarity cuts both ways. A driver who makes the same U-turn on Baytree Road every weekend will make it the night you’re crossing.

How long do you have after a downtown or Remerton crash?

Most of these claims carry Georgia’s two-year deadline to file a lawsuit. A claim against the City of Valdosta or the City of Remerton, such as a crash with a city vehicle or a fall on a broken sidewalk, needs written notice within six months. Lowndes County gets twelve. Which city you were in decides where the notice goes.

Who caused the harmDeadlineGeorgia law
A drunk driver, a rideshare driver or another private driver2 years to file a lawsuitO.C.G.A. § 9-3-33
A bar or restaurant that overserved the driver2 years to file a lawsuitO.C.G.A. § 9-3-33
The City of Valdosta or the City of Remerton: a city vehicle, a street, a sidewalk or a signal6 months to send written noticeO.C.G.A. § 36-33-5
Lowndes County: a county vehicle or a county road12 months to send written noticeO.C.G.A. § 36-11-1

One wrinkle that catches people. If the drunk driver is prosecuted, the two-year clock on your civil claim can be paused while the criminal case is pending, up to a limit. That is a reason to breathe, not a reason to wait. Video from the strip is usually gone within days, and the bar’s records of what the driver was served do not keep themselves.

Which court hears a Valdosta or Remerton injury case?

An injury lawsuit from a crash in downtown Valdosta or Remerton is usually filed in the State Court or Superior Court of Lowndes County at the courthouse on North Patterson Street, part of the Southern Judicial Circuit. The criminal DUI case against the driver is a separate matter. Most claims settle with an insurer before anyone files.

A Lowndes County jury knows the Remerton strip on a Friday night. They know the difference between a student walking home and a driver who should have called a ride, and a case built on the report, the video and the records lets them see it.

What this means for your claim

A drunk driving crash in Valdosta or Remerton is one of the few injury claims where the other side’s conduct can raise the value of your case rather than just the size of your bills. A rideshare crash is one of the few where a million dollar policy sits behind the driver. Both depend on evidence that disappears quickly and on not saying the wrong thing to an adjuster in the first week.

Our pages on injury claims against drunk drivers in Georgia and Uber and Lyft accident claims go deeper on the law. If you were on foot, pedestrian injury claims in Lowndes County explains how fault works when there was no second car. For a wreck with no alcohol involved, see car wreck claims in Valdosta. For the streets near campus, crashes on North Ashley Street and near Valdosta State covers the university’s own rules, and tractor-trailer crashes on I-75 through Lowndes County covers the interstate.

What should you do this week?

  1. Get checked out. South Georgia Medical Center on North Patterson Street sees these crashes around the clock, and the first record is the one the insurer reads.
  2. Get the report number, and note whether it was Valdosta Police or Remerton Police. Ask whether the driver was arrested or tested.
  3. Screenshot the rideshare trip if you were in one, including the pickup point, the route and the driver’s name.
  4. Write down which bar the driver came from if you know it, and the names of anyone who saw them leave.
  5. Call 229-850-5645 and talk with the Valdosta attorneys who handle DUI and rideshare cases. Don’t sign anything or give a recorded statement first.

Our Valdosta office is at 2935 North Ashley Street, Suite 127, a few minutes from downtown and from Remerton. The consultation is free, you pay nothing up front, and there’s zero fee unless we win.

What do these terms mean?

  • Punitive damages. Money a jury awards to punish a wrongdoer, on top of what it takes to repay your losses. Georgia allows them against drunk drivers.
  • Dram shop law. The Georgia rule that lets you sue a bar or restaurant that served a noticeably drunk person who then drove and hurt someone.
  • Transportation network company. The legal name for a rideshare company such as Uber or Lyft.
  • Uninsured motorist coverage. Part of your own auto policy, or a parent’s, that pays when the driver who hit you had no insurance or fled.
  • Comparative fault. Georgia’s rule that reduces your recovery by your share of the blame, and ends it if you were 50 percent or more at fault.
  • Ante litem notice. A written notice you must send to a city, a county or the state before you can sue it. The Latin means “before the lawsuit.”
