Hurt in a crash in Hahira or Lake Park?

Hahira and Lake Park sit at either end of I-75 in Lowndes County, Hahira at exit 29 and Lake Park at exits 2 and 5 by the Florida line. Each has its own police and a six-month deadline for claims against the city. Outside the city limits, the Sheriff and the State Patrol work crashes. Lowndes has no county police.

Maybe you were on US 41 in Hahira, headed to work in Valdosta, and a driver pulled out of a side street without looking. Maybe you were at the Lake Park exit on a Friday, in the line of cars coming off I-75 for gas, and a pickup rear-ended you at the light. Maybe you were walking Main Street during the Honeybee Festival with the kids and a car turned into the crowd. Now you’re sore, the car is at a body shop, and an adjuster wants a statement before you’ve seen a doctor.

Kenneth S. Nugent, P.C. has represented injured Georgians since 1980, and our office on North Ashley Street in Valdosta is ten minutes from Hahira and fifteen from Lake Park. This page covers who has your report, why the six-month city deadline matters in both towns, what changes when the crash was at the Florida line, and what to do this week. The consultation is free, and there’s zero fee unless we win.

Don’t sign anything an insurance company sends you, and don’t give a recorded statement, before you’ve talked with an attorney.

Who has your crash report in Hahira or Lake Park?

Hahira Police keep crash reports for wrecks inside Hahira’s city limits, and Lake Park Police keep them for Lake Park’s. Crashes on I-75 and the county roads between the towns belong to the State Patrol post in Valdosta or the Sheriff. A crash south of the Florida line, past Lake Park, belongs to the Florida Highway Patrol.

The city limits in both towns are smaller than the places that use their names. Much of what people call Hahira is county land along US 41, and most of the businesses at the Lake Park exits sit just outside the city. If you’re not sure which agency came, look at the card or slip the officer handed you. If nobody came, which happens on minor wrecks, file a report yourself with the agency that covers the spot.

Georgia limits who can get a crash report to the people named in it, their lawyers and their insurers. A family member can usually pick one up for you if you’re still recovering.

What makes crashes in these towns different?

Hahira is a town of about 3,400 people along US 41, with I-75 traffic at exit 29 and a festival each fall that fills Main Street. Lake Park is a town of a few hundred people whose exits serve the welcome center and everyone headed to or from Florida. Most serious crashes here are interstate traffic meeting town speeds.

The kind of crashWhere it happens hereHow fault usually works
Rear-end at an exit ramp lightExit 5 in Lake Park, exit 29 in Hahira, where interstate traffic stacks up for gas and foodThe driver who hit from behind is usually at fault. Following too closely is the reason, not an excuse.
Pull-out onto US 41Side streets and driveways in Hahira and along the highway between the townsThe driver entering the highway usually has to yield. A through driver who was speeding shares the blame.
Out-of-state driversEverywhere near the Lake Park exitsThe claim is still a Georgia claim, but the insurer may be in another state and slower to deal with. We handle that.
Festival and event trafficMain Street in Hahira during the Honeybee Festival, the parade route and the parking fieldsPedestrian crashes in a crowd come down to video and witnesses. Both disappear within days.
Truck crashes at the exitsThe travel centers at exits 2 and 5, the ramps at exit 29A tractor-trailer brings federal rules and a bigger insurance policy. See the I-75 page below.

Small-town crashes have a problem city crashes don’t. There is often no camera, few witnesses and a long wait for the ambulance from Valdosta. Your own photographs at the scene, taken before the cars are moved, carry more weight here than they would on North Ashley Street, and the insurer knows it.

How long do you have after a Hahira or Lake Park crash?

If another driver hurt you, Georgia gives you two years to file suit. If the City of Hahira or Lake Park caused the crash through a city vehicle, employee or street, notice is due within six months. If Lowndes County was responsible, you have twelve months. A claim about I-75 or US 41 itself is against the state, twelve months.

Who caused the harmDeadlineGeorgia law
Another driver, a business or a trucking company2 years to file a lawsuitO.C.G.A. § 9-3-33
The City of Hahira or the City of Lake Park: a city vehicle, a city employee on duty, a city street or sidewalk6 months to send written noticeO.C.G.A. § 36-33-5
Lowndes County: a county vehicle, a deputy on duty, a county road12 months to send written noticeO.C.G.A. § 36-11-1
The State of Georgia: a state vehicle, or the design or upkeep of I-75 or US 4112 months to send written noticeO.C.G.A. § 50-21-26

Six months goes fast when you’re recovering. The notice is not a lawsuit. It is a letter that tells the city when and where the crash happened, what the harm was and roughly what you’re asking for, sent the right way to the right office. A notice that arrives in month seven is too late, and getting the form wrong can cost you the claim. If a city truck, a city officer or a city street is anywhere in the story, call us well before the six months are up.

If the crash was south of the Florida line, none of these deadlines apply. Florida has its own rules on fault, insurance and timing, and they are different from Georgia’s. Our Valdosta office has an attorney licensed in both states. Tell us which exit you were near and we’ll sort out which law governs.

Which court hears a Hahira or Lake Park injury case?

An injury lawsuit from a crash in Hahira or Lake Park is usually filed in the State Court of Lowndes County or in Superior Court, part of the Southern Judicial Circuit, at the Lowndes County Judicial Complex in Valdosta. Each town’s municipal court handles traffic tickets, not injury claims. Smaller civil claims, up to $15,000, can go to Magistrate Court.

A ticket in Hahira or Lake Park municipal court against the other driver can help your claim, and a guilty plea there is worth knowing about. Ask us to check the docket before the traffic case is resolved.

What this means for your claim

A crash in Hahira or Lake Park is usually a claim against another driver’s insurance, decided by evidence that is harder to come by than in Valdosta: your photographs, the State Patrol’s report and the first medical record. If a city, the county or the state is in the picture at all, the clock is short and the letter has to be right.

For a wreck between two vehicles, see car wreck claims in South Georgia. If a tractor-trailer was involved at one of the exits, truck accident claims in Georgia explains why those cases move differently, and truck and car crashes on I-75 through Lowndes County covers the interstate between the two towns. If you were on foot, pedestrian accident claims near Valdosta covers how fault works when there was no second car. Closer to the city, crashes on Bemiss Road and near Moody, wrecks on North Ashley Street and near Valdosta State and drunk driving crashes in downtown Valdosta and Remerton cover the rest of the county.

What should you do this week?

  1. Get checked out, even if the ambulance didn’t take you. SGMC Health in Valdosta is the hospital for the whole county, and the first record is the one insurers read.
  2. Find out which agency wrote the report, Hahira or Lake Park Police, the Sheriff or the State Patrol, and get the report number.
  3. Photograph both vehicles and the road before anything is moved or repaired. Out here the pictures often are the evidence.
  4. Write down the road, the nearest crossroads or exit, your direction and whether a city or county vehicle was involved.
  5. Call 229-850-5645 and talk with the Valdosta attorneys who handle Hahira and Lake Park crashes. Don’t give a recorded statement or sign anything first.

Our Valdosta office is at 2935 North Ashley Street, ten minutes from Hahira by US 41 and fifteen from Lake Park by I-75. The consultation is free, you pay nothing up front, and there’s zero fee unless we win.
