AFTER THE ACCIDENT

Hurt on Camp Creek Parkway, Old National Highway or Fulton Industrial?

South Fulton is one of the youngest big cities in Georgia. Voters approved it in November 2016, and it became a city on May 1, 2017. More than 110,000 people live there now, across about 86 square miles of southwest Fulton County, from the warehouses along Fulton Industrial Boulevard down past Wolf Creek and the Camp Creek shopping district.

Here’s what people get wrong. Almost nobody’s mail says South Fulton. Depending on the ZIP code, a South Fulton address can read Atlanta, Fairburn, Union City, Palmetto or even Riverdale, and some of those are separate cities with their own police. The police changed too. Fulton County Police covered this area for more than forty years, and the city’s own department took over on March 26, 2018. So an older report, or an old letter from a county office, may say Fulton County when the city is the one that answers for it now. Maybe someone ran the light on Old National Highway, or a truck backed out of a loading dock off Fulton Industrial and caught your car. Now you’re hurting and an adjuster wants a statement. Our Atlanta office handles South Fulton cases and can tell from a street name which government you’re dealing with.

Don’t sign anything an insurance company sends you, whether it’s a statement, a medical release or a check, before you’ve talked with an attorney.

Car and truck accidents in South Fulton

Most South Fulton crashes happen on Camp Creek Parkway, Old National Highway, Fulton Industrial Boulevard and the interstate ramps that feed them. Camp Creek Parkway carries airport and shopping traffic at highway speed, and the warehouse district along Fulton Industrial puts tractor-trailers and box trucks in the same lanes as commuters.

A wreck with a delivery van, a freight truck or a rideshare driver headed to the airport can bring a commercial policy and an employer into the claim. We start by finding every policy behind car wreck claims in South Fulton. If a tractor-trailer hit you near the distribution centers on Fulton Industrial, read how we handle South Fulton truck crashes. Riding a motorcycle? Our page for riders hurt in South Fulton explains what changes on two wheels.

Camp Creek Parkway is wide and fast, and people on foot cross it between bus stops, apartments and stores. If a car hit you or someone you love walking, read about pedestrians hit in South Fulton. The other side is quick to blame the person on foot. We are not.

Falls, dog bites and workplace injuries in South Fulton

Falls in stores and parking lots, dog bites and injuries at work happen all over South Fulton, from the Camp Creek shopping centers to the warehouses and distribution centers along Fulton Industrial Boulevard. Who owned or controlled the spot where you were hurt decides how the claim works, and if a government owned it, the rules get stricter.

If you slipped on a wet floor or tripped in a parking lot, our page on South Fulton slip and fall claims explains what an owner had to know. Hurt on the job loading trucks, working a warehouse floor or on a construction site? Workers’ comp has its own forms and deadlines, and our workers’ comp help for South Fulton workers walks through them. A fall on a city sidewalk or in a city park puts the city’s short notice clock in play. Some claims against governments are limited by law.

Serious injuries and wrongful death

A serious wreck on Camp Creek Parkway or the interstate can change a family’s life in one afternoon. The closest Level I trauma center is Grady in downtown Atlanta, so the worst injuries from South Fulton usually ride there. A brain injury, a spinal injury or a death means years of care to pay for.

Early offers arrive before anyone knows those costs. If your family lost someone, read about wrongful death claims after a South Fulton crash. If the harm happened during treatment afterward, our page on when hospital care after a South Fulton wreck makes things worse explains the extra steps Georgia requires. How long do you have to file a claim in South Fulton?

A claim against a driver or a business in Georgia generally has a two-year deadline to file suit. If a government played a part, written notice can be due much sooner. For the City of South Fulton, that’s generally six months. For Fulton County or the state, generally twelve. Getting the right government matters as much as the date.

Who you’re claiming againstWhat usually comes firstHow long, generally
The driver, or the company the driver worked forA claim with their insurer, then a lawsuit if neededTwo years to file suit, under O.C.G.A. § 9-3-33
The City of South Fulton, including a city police car, a city street or a city parkA written ante litem notice to the citySix months, under O.C.G.A. § 36-33-5
A neighboring city, such as East Point, College Park, Union City or FairburnA written ante litem notice to that citySix months, under O.C.G.A. § 36-33-5
Fulton County, for a county vehicle or a county buildingA written notice to the countyTwelve months, under O.C.G.A. § 36-11-1
The State of Georgia, for a defect on a state route such as Camp Creek ParkwayA written ante litem notice to the stateTwelve months, under O.C.G.A. § 50-21-26

Ante litem is Latin for “before the lawsuit.” It’s a letter a government must get before it can be sued. Here’s where South Fulton catches people. Before 2017 a broken signal on a side street here was Fulton County’s to answer for, on twelve months. Now most of those streets belong to the city, on six. And a notice sent to Fairburn because the envelope said Fairburn does nothing if the crash was inside South Fulton.
