AFTER THE ACCIDENT

Hurt on Camp Creek, Old National or near the airport?

College Park is a city of about 14,000 people just south of Atlanta, and it sits in two counties. Most of the city is in Fulton County. A smaller piece to the south, around Riverdale Road on the southwest side of the airport, is in Clayton County. One police department covers both sides of that line.

Maybe a driver ran a light on Camp Creek Parkway. Maybe someone turned across your lane on Old National Highway, or a hotel shuttle cut over on Virginia Avenue. Maybe traffic stopped short on I-85 by the airport exits. Now you’re sore, your car is in a tow yard and an adjuster wants a recorded statement. That’s a lot to carry, and none of it is yours to sort out alone. Not sure which side of the county line you were on? Our Atlanta office handles College Park cases and can work it out from a street name or a landmark.

Don’t sign anything from an insurance company, whether it’s a statement, a medical release or a check, before you’ve talked with an attorney.

None of College Park is in DeKalb County, so DeKalb’s courts and deadlines don’t come into it. The line that matters is the one between Fulton and Clayton. Two crashes a few miles apart can both be College Park Police cases, yet a lawsuit over each one could be filed in a different county. Where a case is filed usually turns on who you’re suing and where they are, and sometimes on where the crash happened, not on your home address. For the details on each side, read how Fulton County courts handle College Park claims and the Clayton County side of College Park.

Part of Hartsfield-Jackson sits inside College Park’s city limits, but the City of Atlanta owns and runs the airport. If you were hurt in a terminal, on a shuttle or at a gate, start with our guide to injuries at the airport next to College Park.

Car and truck accidents in College Park

Many College Park crashes happen on a handful of roads: Camp Creek Parkway, Old National Highway, Riverdale Road, Virginia Avenue and the stretches of I-85 and I-285 that run through town. Airport traffic, hotel shuttles, rideshare pickups and delivery trucks share those lanes, and that mix changes who may be responsible.

A wreck with a hotel shuttle, a rideshare driver or a delivery truck can bring a commercial insurance policy into the picture, along with a company that may share the blame. We start by finding every policy that applies to car wreck claims along the airport corridor. If a tractor-trailer or box truck hit you, read how we handle truck crashes near the airport. Riders have their own page too, for riders hurt on Camp Creek or Old National.

Old National Highway has busy bus stops, and people on foot get hurt there. In 2022 a driver lost control at Old National Highway and Sullivan Road and hit a MARTA bus shelter with two people waiting inside. If you were on foot when you were hit, read about people hit while walking in College Park.

Falls, dog bites and workplace injuries in College Park

College Park has more than 5,000 hotel rooms, a convention center, an arena and thousands of jobs tied to the airport. Falls in hotels and parking decks, injuries at work and dog bites all happen here. Who owned or controlled the spot where you were hurt usually decides how the claim works.

If you slipped on a wet hotel floor or fell on broken stairs, our page on slip and fall claims near the airport hotels explains what an owner had to know. Hurt on the job at a hotel, a warehouse or the airport? Workers’ comp has its own forms and deadlines, and our workers’ comp help for College Park workers walks through them. If you fell on city property, such as a city building or sidewalk, the six-month notice rule below may apply.

Serious injuries and wrongful death

When a College Park crash or fall causes a brain injury, a spinal injury or the loss of someone you love, the claim is about years of care and lost income, not just this month’s bills. These cases need careful work from the start, because early offers often come before anyone knows the full cost.

If your family lost someone, read about wrongful death claims after a College Park crash. If the harm happened during treatment afterward, our page on mistakes made during hospital care explains the extra steps Georgia requires. Kenneth S. Nugent, P.C. has helped injured Georgians since 1980. You pay nothing up front, and there’s zero fee unless we win.

How long do you have to file a claim in College Park?

A claim against a driver or a business in Georgia generally has a two-year deadline to file suit. If a government played a part, written notice can be due much sooner. For the City of College Park, that’s generally six months. For Fulton County, Clayton County or the state, it’s generally twelve months.

Who you’re claiming againstWhat usually comes firstHow long, generally
The driver, or the company the driver worked forA claim with their insurer, then a lawsuit if neededTwo years to file suit, under O.C.G.A. § 9-3-33
The City of College ParkA written ante litem notice to the citySix months, under O.C.G.A. § 36-33-5
Fulton CountyA written notice to the countyTwelve months, under O.C.G.A. § 36-11-1
Clayton CountyA written notice to the countyTwelve months, under O.C.G.A. § 36-11-1
The State of Georgia, for a defect on a state road or interstateA written ante litem notice to the stateTwelve months, under O.C.G.A. § 50-21-26

Which county row applies follows where you were hurt, not your mailing address. Fulton County has almost no land left outside a city, so a government claim on the Fulton side usually points to a city. Just past the city line on the Clayton side, some land is unincorporated, so a Clayton County claim is more likely there.

Who has your crash report in College Park?

Inside the city limits, College Park Police usually work the crash and keep the report, on either side of the county line. Just outside, it depends on the neighbor: East Point, Atlanta or South Fulton police on the Fulton side, and Clayton County Police in unincorporated Clayton. Georgia State Patrol troopers may work interstate crashes.
