Which part of I-285 were you on?
I-285, the Perimeter, is the 64-mile loop around Atlanta. It runs through four counties: Fulton, Cobb, DeKalb and Clayton. The county where your crash happened shapes which police agency likely wrote the report, which government deadlines could apply and which courthouse may hear a claim. Start by placing yourself on the loop.
Maybe traffic stopped dead at the I-75 interchange near Cumberland and the car behind you didn’t. Maybe a tractor-trailer drifted into your lane near GA-400. People say “I wrecked on 285” as if it’s one place. It isn’t. A crash at the Cobb Cloverleaf and a crash near the Stone Mountain Freeway exit happen in different counties, with different courts and often a different kind of officer. Not sure where you were? Write down the exit number and your direction. The inner loop runs clockwise around the city and the outer loop runs counterclockwise. That detail, plus the exit, lets an investigator place the crash on the right side of a county line.
Who writes the report on I-285?
It depends on where you were on the loop. Inside a city, that city’s police may respond. In unincorporated parts of Cobb, DeKalb and Clayton, county police often handle it. A Georgia State Patrol trooper can work a crash anywhere on the interstate. The agency named on the officer’s card is the one that keeps your report.

Which courthouse hears a Perimeter crash?
Each of the four counties has its own State Court and Superior Court. A crash in Cobb is a Cobb County matter, and a crash in DeKalb is a DeKalb matter, even though both happened on the same highway. A lawsuit against another driver, though, is generally filed where that driver lives, so the crash county isn’t always the answer.
That’s why people who say “Atlanta” often mean four different court systems. Each county has its own courthouse, its own police and its own notice rules for claims against local government. How long do you have after an I-285 crash?
It depends on who was at fault. A claim against another driver or a trucking company generally has a two-year deadline to file suit in Georgia. If the road itself played a part, I-285 is a state highway, and a claim against the state generally needs a written notice within twelve months.

What if a truck was involved?
Big trucks passing through Atlanta are generally required to use I-285 instead of driving through downtown, so the Perimeter carries heavy truck traffic day and night. A tractor-trailer crash can involve the driver, the trucking company, its insurer and sometimes a separate trailer owner. The truck’s own data can show speed and braking.

- Inner loop and outer loop. The two directions of I-285. The inner loop runs clockwise and the outer loop runs counterclockwise.
- Spaghetti Junction. The common name for the Tom Moreland Interchange, where I-285 meets I-85 in DeKalb County.
- Unincorporated. Land inside a county but outside any city. County police and county rules usually apply there.
- State Court. A county court that hears many civil cases, including injury claims. Each metro county has its own.
- Ante litem notice. A written notice some government bodies must get before you can sue them. It’s Latin for “before the lawsuit.”
