Who is responsible for the place you were hurt in Cobb County?
In Cobb County, the answer often isn’t the city on your mailing address. Big parts of the county, including the Cumberland area around Truist Park and The Battery, sit outside every city’s limits. Which government owns the road or property decides who gets your written notice and how long you have to send it.
If you’re reading this, something already went wrong. Maybe it was a crash leaving a ballgame, a fall in a parking deck, or a wreck on a road you drive every day. Nobody wants a civics lesson while they’re hurting, and sorting out the government side is our job. Still, a few Cobb facts are worth knowing now, because they surprise people who have lived here for decades.
Don’t sign anything an adjuster puts in front of you before you’ve talked with a lawyer. A quick signature can close doors you didn’t know were open.
Start with the ballpark. Truist Park and The Battery use an Atlanta mailing address, but they aren’t in the City of Atlanta, and they aren’t in Smyrna or Marietta either. They sit in Cumberland, an unincorporated part of Cobb. So a crash in the lots or on the roads around them is usually worked by Cobb County Police, and a claim against the county for a road it maintains there would generally run on the county’s twelve-month clock.
There’s a second wrinkle. The stadium itself is owned by a public authority, the Cobb-Marietta Coliseum and Exhibit Hall Authority, and the team runs it day to day. An injury inside the ballpark can involve a private operator and a public owner at the same time, and different rules can apply to each. We don’t guess on those. Marietta addresses fool people the same way. Marietta mail reaches far past the City of Marietta. Much of East Cobb, for example, is unincorporated even though plenty of homes there have a Marietta address. The city line decides the rules, not the envelope.
What changed when Mableton became a city?
Mableton voters chose in 2022 to form their own city. A claim against the City of Mableton generally has to be noticed within six months, not the county’s twelve. But Cobb County still supplies Mableton’s police officers, so working out which government is responsible for a given crash can take real digging.
For now, Cobb County Police answer calls inside Mableton under a one-year agreement the city and county signed in June 2026. There was a gap before that. The old agreement ran out at the end of May 2026, and for about two weeks the same officers answered calls as deputies of the Cobb County Sheriff’s Office. If your crash happened in that window, the report may carry the sheriff’s name instead of the police department’s.
Why does that matter? A crash involving a county police car is generally a claim against the county, even inside Mableton’s limits. A broken sidewalk on a street the city is responsible for is generally a claim against the city. Those can land on different clocks, six months or twelve. And this arrangement will likely change again, because the city has said it plans a different approach to public safety down the road.
How long do you have to send notice in Cobb County?
Most Georgia injury claims must be filed within two years. When a government caused the harm, a written notice usually has to reach it much sooner: generally six months for a city like Marietta, Smyrna or Mableton, and twelve months for Cobb County or the state. Because so much of Cobb is unincorporated, the county clock comes up often here.

Which court hears an injury case in Cobb County?
Most Cobb County injury lawsuits are filed in the State Court of Cobb County on Marietta Square, at 12 East Park Square. Some are filed in the Superior Court on Haynes Street instead. Cobb doesn’t have one courthouse. Its courts are spread across several buildings within a few blocks of the Square.

People expect one big courthouse and find three buildings instead. The State Court sits right on the Square. The Magistrate Court is a block over on Waddell Street, and the Superior Court is on Haynes Street. If a hearing ever needs you there, we’ll tell you exactly which building and which door.
A traffic ticket is a separate case from your injury claim. If Cobb County Police wrote the other driver a ticket, it usually goes to the State Court on the Square. If city police wrote it, it usually goes to that city’s municipal court. Mableton now runs its own court, and which Mableton tickets go there instead of State Court was part of the city’s recent dispute with the county, so check the court printed on the citation. The ticket’s outcome may be useful evidence later, but it won’t pay a single medical bill.
What does this mean for your case?

What can you do right now?
- Write down exactly where it happened: the road, the nearest cross street, or the parking deck and level. In Cobb, a few hundred feet can move you from a city into unincorporated county.
- Keep the officer’s card or the report number. Whether it was Cobb County Police, a city department, the Georgia State Patrol or, in early June 2026, the Cobb County Sheriff’s Office tells us a lot about which government may be involved.
- If you were hurt at a stadium, a mall or an event, ask for a copy of any incident report before you leave, or write down the name of the person who took it.
- Hold off on giving a recorded statement to the other side’s insurance company.

Which legal terms will you hear?
- Incorporation. When residents vote to form a city. Mableton did it in 2022, which put new city limits, and a new six-month notice clock, on a big part of south Cobb.
- Intergovernmental agreement. A contract between two governments. It’s how Cobb County Police patrol Mableton today.
- Public authority. A body created by government to own or run something, such as the authority that owns Truist Park. Different notice rules can apply to it.
- Ante litem notice. The written notice a government has to receive before you can sue it. “Ante litem” is Latin for “before the suit.”
