Marietta Car Accident and Injury Lawyers

Hurt on Cobb Parkway, Roswell Road or the Marietta Parkway loop? Marietta is the county seat, so four different agencies write crash reports within a few miles of the Square, and a Marietta address reaches far past the city line. That changes who has your report and how long you have to act. Our Atlanta office handles these cases. Zero fee unless we win.

AFTER THE ACCIDENT

Hurt on Cobb Parkway, Roswell Road or around the Square?

Marietta is the seat of Cobb County. The town was chartered in 1834, a courthouse square and a rail stop grew into a city, and today about 61,000 people live inside roughly 23 square miles, all of it in Cobb. Kennesaw sits to the northwest, Smyrna to the southeast, and Dobbins Air Reserve Base takes up a wide stretch of county ground along the south side of town.

Here’s the catch with Marietta. The mailing address reaches far beyond the city. Much of East Cobb and a good part of West Cobb carry a Marietta address, and most of that ground is unincorporated Cobb County. A crash on Roswell Road near the Big Chicken and one a few miles east toward Johnson Ferry Road can land with two different police departments and two different notice clocks, and nothing on the road marks the line. Maybe a driver ran the light where Cobb Parkway meets Roswell Road under the Big Chicken. Maybe someone pulled out in front of you on Powder Springs Road, clipped you on Whitlock Avenue, or rear-ended you on North Marietta Parkway, the ring road most people still call the 120 Loop. Maybe it was a tractor-trailer on I-75 at the Marietta exits. Now you’re sore, your car is in a tow yard and an adjuster wants a recorded statement. Our Atlanta office handles Marietta cases and can work out whose ground you were on from a street name.

Don’t sign anything an insurance company sends you, whether it’s a statement, a medical release or a check, before you’ve talked with an attorney.

So “my case is in Marietta” needs one more question: which Marietta? Inside the limits, or out in East Cobb or West Cobb on an address that shares the name and not the rules? For how the county side works, read about Cobb County rules for Marietta crashes.

Car and truck accidents in Marietta

Most Marietta crashes happen on Cobb Parkway, Roswell Road, the Marietta Parkway loop, Powder Springs Road, Whitlock Avenue, Canton Road and I-75. Cobb Parkway and Roswell Road are both state routes lined with shopping centers and side streets, and the mix of commuters, delivery vans and freight trucks on them can change who may be responsible for your injuries.

A wreck with a delivery van, a box truck or a rideshare driver headed for the Square can bring a commercial policy and an employer into the claim. We start by finding every policy behind car wreck claims in Marietta. If a tractor-trailer hit you on I-75 between the Marietta Parkway exits or near the I-575 split, read how we handle Marietta truck crashes. Were you on a motorcycle? Our page for riders hurt in Marietta explains what changes when you were on two wheels.

Cobb Parkway and Roswell Road are hard on people on foot. Both are wide and fast, with bus stops, apartments and long gaps between crossings, and Franklin Gateway and Fairground Street bring the same problem closer to downtown. If a car hit you or someone you love walking to a bus or across a parking lot entrance, read about pedestrians hit in Marietta. The other side is quick to blame the person on foot. We are not.

Falls, dog bites and workplace injuries in Marietta

Falls in stores and parking lots, dog bites and injuries at work happen across Marietta, from the restaurants and shops around the Square to the big-box lots on Cobb Parkway and the Kennestone hospital campus. Who owned or controlled the spot where you were hurt decides how the claim works, and if a government owned it, the rules get stricter.

If you slipped on a wet floor or tripped on a broken curb in a parking lot, our page on Marietta slip and fall claims explains what an owner had to know. Hurt on the job at a warehouse, on a construction site or at the hospital? Workers’ comp has its own forms and deadlines, and our workers’ comp help for Marietta employees walks through them. If you fell on a city sidewalk around the Square, in a city park or at a city event, call us early, because the city’s notice clock is short. If it happened in a county building or on the courthouse steps, the county’s longer clock applies instead. Some claims against governments are limited by law.

Serious injuries and wrongful death

A serious wreck on I-75, Cobb Parkway or Roswell Road can change a Marietta family’s life in one afternoon. Since 2024 the worst injuries usually go to Wellstar Kennestone, a Level I trauma center near the Square. When a crash causes a brain injury, a spinal injury or a death, the claim has to cover years of care.

Early offers arrive before anyone knows those costs, so these cases need careful work from day one. If your family lost someone, read about wrongful death claims after a Marietta crash. If the harm happened during treatment afterward, our page on when hospital care after a Marietta wreck makes things worse explains the extra steps Georgia requires. Our guide to trauma care after a Marietta crash explains why the ambulance may have passed a closer hospital. Kenneth S. Nugent, P.C. has helped injured Georgians since 1980. You pay nothing up front, and there’s zero fee unless we win.

How long do you have to file a claim in Marietta?

A claim against a driver or a business in Georgia generally has a two-year deadline to file suit. If a government played a part, written notice can be due much sooner. For the City of Marietta, that’s generally six months. For Cobb County or the state, generally twelve. Which applies depends on where you were and who owned that ground.

Who you’re claiming againstWhat usually comes firstHow long, generally
The driver, or the company the driver worked forA claim with their insurer, then a lawsuit if neededTwo years to file suit, under O.C.G.A. § 9-3-33
The City of MariettaA written ante litem notice to the citySix months, under O.C.G.A. § 36-33-5
The City of Kennesaw or the City of Smyrna, for a crash just across the lineA written ante litem notice to that citySix months, under O.C.G.A. § 36-33-5
Cobb County, for East Cobb, West Cobb or any unincorporated area with a Marietta addressA written notice to the countyTwelve months, under O.C.G.A. § 36-11-1
The State of Georgia, for a defect on a state route such as Cobb Parkway, Roswell Road, the Marietta Parkway loop, I-75 or I-575A written ante litem notice to the stateTwelve months, under O.C.G.A. § 50-21-26
The federal government, for something that happened inside Dobbins Air Reserve BaseA different process appliesCall us to confirm

Ante litem is Latin for “before the lawsuit.” It’s a letter a government must get before it can be sued. Here is why the city line matters so much in Marietta. A pothole on Roswell Road near the Big Chicken is the city’s to answer for, on six months. The same kind of pothole four miles east, past the line in East Cobb, is Cobb County’s, on twelve. Nothing about the road is different. The government responsible for it is, and the clock goes with it. Being the county seat adds a twist. The county government sits inside the city, so a fall on the courthouse steps is a claim against the county, not the city, even though you were downtown. The clock follows who was responsible for that spot, not the name on your mail.

Who has your crash report in Marietta?

Inside the city limits, Marietta Police work the crash and keep the report at headquarters on Lemon Street, a short walk from the Square. In East Cobb, West Cobb and the rest of unincorporated Cobb, it’s Cobb County Police. State troopers work many crashes on I-75, I-575 and Cobb Parkway. The officer’s card tells you which agency it was.

Marietta Police make crash reports available online with your case number and at the records window on Lemon Street on weekdays, usually within a few days of the wreck. If the officer was from Cobb County, Kennesaw or Smyrna, the city will not have it. Lost the card, or left in an ambulance before anyone handed you one?
