Which police agency worked your crash in Clayton County?
In Clayton County, the agency named on your crash report is the first clue to whose rules apply. Clayton County Police work crashes outside city limits. City officers work Jonesboro, Forest Park, Riverdale, Morrow and the other cities. At Hartsfield-Jackson it’s usually Atlanta police, because the City of Atlanta owns the airport.
If you’re here, you’re probably holding a report number and a lot of questions. Maybe it was a wreck on Tara Boulevard, a fall in a terminal, or a crash on the way home from the airport. You shouldn’t have to learn how county government works while you heal. That part is our job. But a few Clayton facts are worth knowing now, because they catch people off guard.

The agency is a clue, not the final answer. Officers respond to wherever the crash happened, while the claim follows whoever owns the road, the vehicle or the property. A Clayton County officer can work a wreck on a state highway, for example. We sort that out by looking at the report, the location and the vehicles together.
Why does the airport follow Atlanta’s rules?
Most of Hartsfield-Jackson sits in unincorporated Clayton County, with smaller pieces in Atlanta, College Park and Hapeville on the Fulton side. The whole airport belongs to the City of Atlanta, though, and the city’s Department of Aviation runs it. So a claim about the airport itself generally runs against the City of Atlanta.
That’s the surprise. You can be standing in Clayton County and still, in most cases, be on Atlanta’s six-month city clock rather than Clayton County’s twelve. The police side follows the owner too. The Atlanta Police Department’s Airport Section patrols the terminals, the concourses and the parking areas, so a report from inside the airport will usually be Atlanta’s, not Clayton County’s.
Not everything at the airport belongs to the city. Airlines, restaurants and shops are private businesses. Security screening is run by TSA, a federal agency, and claims against the federal government follow a different process. Trains into the airport are run by MARTA, which has its own rules. One trip from the curb to the gate can pass through four different owners. We don’t guess on those. Call us and we’ll work out who is responsible.
How long do you have to send notice in Clayton County?
Most Georgia injury claims must be filed within two years. When a government caused the harm, a written notice usually has to reach it much sooner: generally six months for a city, including the City of Atlanta at the airport, and twelve months for Clayton County or the state. Transit and federal claims follow their own process.

City notices carry an extra trap: the letter generally has to ask for a specific dollar amount. Our Fulton page explains how the dollar-amount rule works, and the same state law generally covers every city in Clayton.
Clayton has had MARTA buses since 2015, after voters chose to join the system in 2014. A crash with a MARTA bus is generally not a claim against Clayton County, even when it happens on a county road. MARTA is a transit authority, and a different process applies.

Which court hears an injury case in Clayton County?
Most Clayton County injury lawsuits are filed in the State Court of Clayton County. Unlike some metro counties, Clayton keeps its main courts under one roof. The State Court, the Superior Court and the Magistrate Court all sit in the Harold R. Banke Justice Center at 9151 Tara Boulevard in Jonesboro.

One building makes life simpler. If a hearing ever needs you there, you’ll go to the same address whichever court has your case, and we’ll tell you which floor and courtroom. The public entrance is open weekdays during business hours, so leave time for the security line.
A traffic ticket is a separate case from your injury claim. If Clayton County Police wrote the other driver a ticket, it usually goes to the State Court at the Justice Center. If city police wrote it, it usually goes to that city’s municipal court. Check the court printed on the citation. The ticket’s outcome may help your claim later, but it won’t pay a single medical bill.

A notice sent to the wrong government, or sent after the clock runs out, can end a claim before anyone looks at your injuries. - Write down exactly where it happened: the road and nearest cross street, or at the airport, the terminal, the concourse and the gate or door number.
- Keep the officer’s card or the report number, and note the agency. Clayton County Police, a city department, Atlanta police at the airport, MARTA Police or the Georgia State Patrol each point us in a different direction.
- If you were hurt inside the airport, a hotel or a store, ask staff to write up an incident report before you leave, and get the name of the person who took it.

What do these legal terms mean?
- Unincorporated. Land outside every city’s limits. A lot of Clayton County is unincorporated, and there the county, not a city, handles the roads and the police.
- Custodian. The agency that keeps the official copy of your crash report. It is usually the agency that responded, so at the airport that is often Atlanta police.
- Magistrate Court. The court for smaller civil claims, $15,000 or less in Clayton, with no jury trials.
- Ante litem notice. The written notice a government has to receive before you can sue it. “Ante litem” is Latin for “before the suit.”
