Peachtree Corners is a city with no police department, and that changes two things
Peachtree Corners voted itself into a city in 2012 and is now the largest city in Gwinnett by population. It never built a police force. When you call 911 from Peachtree Parkway, Holcomb Bridge Road, or Spalding Drive, the officer who shows up works for Gwinnett County Police, the same as if the crash were in unincorporated land next door. Most people assume that means the city has nothing to do with their case. It does, and the difference matters on a clock that runs faster than the one everyone quotes.
Kenneth S. Nugent, P.C. has handled Peachtree Corners cases from our Duluth office since before there was a Peachtree Corners to speak of. The office sits about fifteen minutes up Peachtree Industrial Boulevard. Across Georgia we have recovered more than $5 billion for over 300,000 clients in 45 years, from 9 offices, and this corner of Gwinnett has always sent us a steady share of that work.
Don’t sign anything from the insurance company before speaking with an attorney. Their first offer is almost never their best.
Who responds to a crash in Peachtree Corners, and who holds the report
This is the part that trips people up. Peachtree Corners contracts for the basics and leaves policing and fire to Gwinnett County. So the crash report for a wreck at The Forum, on Technology Parkway, or at the Holcomb Bridge and Peachtree Parkway light is a Gwinnett County Police report. The responding agency is usually the first place to request it, and the officer’s card will name the agency and the report number. If a trooper worked a crash on the GA-141 corridor, the report belongs to Georgia State Patrol instead.
| Where the crash happened | Who usually responds |
|---|---|
| Anywhere inside Peachtree Corners city limits (Peachtree Pkwy, Holcomb Bridge Rd, Spalding Dr, The Forum, Technology Park) | Gwinnett County Police Department |
| Unincorporated Gwinnett around the city | Gwinnett County Police Department |
| GA-141 or Peachtree Industrial Blvd when a trooper responds | Georgia State Patrol |
| Across the Chattahoochee on Holcomb Bridge Rd (Roswell, Fulton County) | Roswell Police Department or Fulton County |
One more wrinkle. Holcomb Bridge Road crosses the Chattahoochee into Roswell and Fulton County within a couple of miles of the Peachtree Parkway intersection. A crash on the bridge or just past it is a different county, a different police department, and a different courthouse. Where the tires were when it happened decides all three, which is why we ask for the exact location before anything else.
The six-month clock that still runs, police or not
Two years is the general deadline for filing a Georgia injury lawsuit. When a government is on the other side, the deadline to give formal notice is much shorter, and here is where the city question comes back. Peachtree Corners is a real municipality under Georgia law. It owns and maintains city streets, sidewalks, the Town Center, and Town Green. If a city-maintained road defect, a broken sidewalk outside a city building, or a city vehicle caused your injury, the claim runs against the City of Peachtree Corners, with a six-month ante litem notice requirement, even though no city officer ever showed up at the scene. Miss that notice and the claim is generally over.
| Who caused the harm | Deadline to send notice | Georgia law |
|---|---|---|
| The City of Peachtree Corners (city streets, sidewalks, Town Center, city vehicles) | 6 months | O.C.G.A. § 36-33-5 |
| Gwinnett County (county police vehicles, county roads, county property) | 12 months | O.C.G.A. § 36-11-1 |
| The State of Georgia or GDOT (GA-141 Peachtree Pkwy, GA-140 Holcomb Bridge Rd, Peachtree Industrial Blvd) | Generally 12 months, with specific delivery rules | O.C.G.A. § 50-21-26 |
| A private driver or business | 2 years to file suit | O.C.G.A. § 9-3-33 |
Peachtree Parkway and Holcomb Bridge Road are state routes, so a claim about the road itself, a signal that failed or an intersection everyone has complained about, is a claim against the state with the state’s notice rules. The county maintains a different set of roads, and the city a third. Sorting out which one owned the pavement is our job, and it is one of the first letters we send.
Where Peachtree Corners crashes happen
The city has one spine, Peachtree Parkway, and everything feeds it. The stretch between Holcomb Bridge Road and Spalding Drive, with The Forum on one side and Town Center on the other, is where most of the rear-end and left-turn wrecks we see come from. Holcomb Bridge Road carries commuter traffic toward Roswell and I-285 at speeds the road was not designed for. Peachtree Industrial Boulevard along the east edge is faster still. And Technology Parkway, home to the city’s autonomous vehicle test track, brings the occasional crash that involves a test car or a fleet vehicle and a different kind of insurance file.
Our Georgia car accident lawyers handle the everyday version of all of those: report, medical bills, adjuster, claim. Free consultation, available around the clock, zero fee unless we win. When a tractor-trailer coming off Peachtree Industrial or serving the warehouses along Technology Park is involved, our truck accident lawyers send a preservation letter to the carrier early, since some fleet records may be overwritten on short retention cycles. Riders on Spalding Drive and East Jones Bridge Road go to our motorcycle accident lawyers. Anyone hit crossing Peachtree Parkway on foot, and there are more of those since Town Center opened, should read what our pedestrian accident lawyers say about crosswalk cases. And if the driver who hit you had been drinking at one of the Forum restaurants, our drunk driving accident lawyers explain why punitive damages in those cases are not capped.
Falls, dog bites, and injuries at work in Peachtree Corners
Falls. The Forum and Town Center are private property with private owners, security cameras, and incident reports of their own. The garages and the crossings between them are where most of the Peachtree Corners fall cases start. The older apartment complexes off Holcomb Bridge and Spalding are the other source, and those turn on how long a landlord knew about a hazard. Our Georgia slip and fall lawyers figure out who owned the hazard and how long they knew.
Dog bites. The neighborhoods along the river and around Simpsonwood are full of dogs, and the bite cases here turn on the Gwinnett Animal Welfare record and whether the county leash ordinance was broken. That is where our dog bite lawyers start.
Injuries at work. Technology Park is one of the biggest office and light-industrial employment centers in the county, and a lot of Peachtree Corners residents work there or in the warehouses along Peachtree Industrial. Georgia workers’ compensation has its own rules, its own deadlines, and its own doctor list. Our workers’ compensation lawyers can tell you which apply to your job.
Catastrophic injuries and deaths. Brain and spinal injuries, and wrongful death claims, are staffed differently from the start, with medical specialists and life care planners brought in early. Our traumatic brain injury lawyers, wrongful death lawyers, and medical malpractice lawyers explain those cases on their own pages, including the affidavit rule that makes a malpractice claim different from every other kind.
The first week: what to save before it disappears
Serious crashes on this side of the county usually go to Northside Hospital Gwinnett in Lawrenceville or to Emory Johns Creek, just across the river. If that is where you woke up, keep every discharge sheet and imaging disc, and ask for the responding agency and report number from the paperwork the ER kept. If you were treated and released, see your own doctor within a day or two anyway. Concussion and soft-tissue symptoms often show up after the adrenaline wears off, and an adjuster will treat a gap in the record as if nothing was wrong.
Then think about footage. The Forum, Town Center, the gas stations at the Holcomb Bridge and Peachtree Parkway corner, and most of the office buildings on Technology Parkway have cameras pointed at the road. That footage may be overwritten on short retention cycles, sometimes within days. We send a preservation request to every property that could have seen the crash, and we do it in the first week, which is one of the reasons calling sooner matters more than calling with everything organized.
