Who has your crash report in Garden City?

Inside Garden City limits, the Garden City Police Department usually writes the crash report. Just outside the city, in unincorporated Chatham County, it’s often the Chatham County Police Department. The Georgia State Patrol works some crashes on state routes and interstates. On port property, the Georgia Ports Authority Police may handle it instead.

The city line isn’t always where you’d guess. Stretches of Dean Forest Road and the roads near I-16 sit outside Garden City, so two crashes a few hundred yards apart can end up with two different agencies. There’s one more wrinkle. To get a Garden City police report yourself, the city takes open records requests and has a request form just for accident reports. The Georgia Ports Authority Police keep their records at 100 Main Street in Garden City. You’re welcome to handle it, but you don’t have to. How long do you have to file a claim in Garden City?

Chatham County and the State of Georgia generally allow twelve months. The clock usually starts on the day you were hurt.

That written notice is called an ante litem notice. The words are Latin for “before the suit,” and in plain terms it’s a formal letter you have to send the government before you’re allowed to sue it. For the City of Garden City, the notice generally has to state the specific amount of money you’re asking for. Send it late or leave out what the law requires, and the claim can be lost.
