Chamblee Car Accident and Injury Lawyers

Hurt on Peachtree Boulevard, Buford Highway or Chamblee Dunwoody Road? Chamblee is one of the oldest cities in DeKalb, but much of it was county ground a dozen years ago, and the airport inside the city still belongs to the county. That changes who wrote your report and how long you have to act. Our Atlanta office handles these cases. Zero fee unless we win.

AFTER THE ACCIDENT

Hurt on Peachtree Boulevard, Buford Highway or near the airport?

Chamblee is an old city that got big fast. It was incorporated in 1908 as a rail town, and for most of a century it stayed small, a few square miles around the depot where Peachtree Road becomes Peachtree Boulevard. Then it grew by annexation. In 2010 the city took in Huntley Hills and the neighborhoods to its northwest. In November 2013, voters approved a much larger annexation of the Dresden East area, roughly 11,000 people in what had been unincorporated DeKalb County, and it took effect at the end of that year. The city’s population roughly tripled between the 2010 and 2020 counts, to about 30,000 people on about 7.7 square miles, all of it inside DeKalb.

That history matters for an injury claim. Streets that were county ground in 2013, patrolled by DeKalb County Police under the county’s twelve-month notice rule, now belong to the City of Chamblee and its six-month clock. It is Brookhaven’s story in reverse: an old city that absorbed county ground rather than a new city carved out of it. And one large piece of ground inside the city never changed hands at all. DeKalb-Peachtree Airport, between Clairmont Road and Chamblee Tucker Road, sits inside the Chamblee city limits but is owned by DeKalb County. Maybe someone ran the light where Chamblee Dunwoody Road meets Peachtree Boulevard. Maybe a driver cut across you on Buford Highway near the police department, or rear-ended you on Clairmont Road by the airport. Now you’re sore, your car is in a tow yard and an adjuster wants a recorded statement. Our Atlanta office handles Chamblee cases and can work out whose ground you were on from a street name.

Don’t sign anything an insurance company sends you, whether it’s a statement, a medical release or a check, before you’ve talked with an attorney.

So “my case is in Chamblee” needs one more question: which Chamblee? The old city, the annexed neighborhoods, the airport, or the county ground outside the line? The limits moved in 2010 and again at the end of 2013, and plenty of maps, adjusters and long-time residents still carry the old line in their heads. A Chamblee mailing address proves nothing either way. For how the county side works, read about DeKalb County rules for Chamblee crashes.

Car and truck accidents in Chamblee

Most Chamblee crashes happen on Peachtree Boulevard, Buford Highway, Chamblee Dunwoody Road, Chamblee Tucker Road, Clairmont Road, Peachtree Industrial Boulevard, I-85 and I-285. Peachtree Boulevard and Buford Highway are both state routes that carry commuters, delivery vans and freight trucks all day, and that mix of drivers can change who may be responsible for your injuries.

A wreck with a delivery van, a box truck or a rideshare driver can bring a commercial policy and an employer into the claim. We start by finding every policy behind car wreck claims in Chamblee. If a tractor-trailer hit you on I-85 at Clairmont Road or on Peachtree Industrial Boulevard, read how we handle Chamblee truck crashes. If it happened on the Perimeter along the city’s north side, our page on I-285 crashes near Chamblee explains who works those wrecks. Were you on a motorcycle? Our page for riders hurt in Chamblee explains what changes when you were on two wheels.

Buford Highway is the hard one here too. It runs the length of the city, seven lanes wide with long gaps between crossings, and people walk to the bus, the store and work along it every day. The rate of people killed crossing it has run several times higher than on any other road in Georgia. If a car hit you or someone you love on foot, read about walking across Buford Highway in Chamblee and about pedestrians hit in Chamblee. The other side is quick to blame the person on foot. We are not.

Falls, dog bites and workplace injuries in Chamblee

Falls in stores and parking lots, dog bites and injuries at work happen across Chamblee, from the shops along Peachtree Boulevard and the plazas on Buford Highway to the hangars and warehouses around DeKalb-Peachtree Airport. Who owned or controlled the spot where you were hurt decides how the claim works, and if a government owned it, the rules get stricter.

If you slipped on a wet floor or tripped on a broken curb in a parking lot, our page on Chamblee slip and fall claims explains what an owner had to know. Hurt on the job in a hangar, a warehouse, a kitchen or a shop? Workers’ comp has its own forms and deadlines, and our workers’ comp help for Chamblee workers walks through them. If you fell on a city sidewalk or in a park the city runs, call us early. If it happened on airport property, the owner may be the county rather than the city, and the clock is different. Some claims against governments are limited by law.

Serious injuries and wrongful death

A serious wreck on I-85, I-285 or Buford Highway can change a Chamblee family’s life in one afternoon. When a crash causes a brain injury, a spinal injury or a death, the claim has to cover years of care and lost income. Early offers arrive before anyone knows those costs, so these cases need careful work from day one.

If your family lost someone, read about wrongful death claims after a Chamblee crash. If the harm happened during treatment afterward, our page on when hospital care after a Chamblee wreck makes things worse explains the extra steps Georgia requires. Kenneth S. Nugent, P.C. has helped injured Georgians since 1980. You pay nothing up front, and there’s zero fee unless we win.

How long do you have to file a claim in Chamblee?

A claim against a driver or a business in Georgia generally has a two-year deadline to file suit. If a government played a part, written notice can be due much sooner. For the City of Chamblee, that’s generally six months. For DeKalb County or the state, generally twelve. Which applies depends on where you were and who owned that ground.

Who you’re claiming againstWhat usually comes firstHow long, generally
The driver, or the company the driver worked forA claim with their insurer, then a lawsuit if neededTwo years to file suit, under O.C.G.A. § 9-3-33
The City of ChambleeA written ante litem notice to the citySix months, under O.C.G.A. § 36-33-5
The City of Brookhaven or the City of Dunwoody, for a crash just across the lineA written ante litem notice to that citySix months, under O.C.G.A. § 36-33-5
DeKalb County, for the airport or for an unincorporated area with a Chamblee addressA written notice to the countyTwelve months, under O.C.G.A. § 36-11-1
The State of Georgia, for a defect on a state route such as Peachtree Boulevard, Buford Highway, I-85 or I-285A written ante litem notice to the stateTwelve months, under O.C.G.A. § 50-21-26

Ante litem is Latin for “before the lawsuit.” It’s a letter a government must get before it can be sued. Here is why the annexation matters. Before the end of 2013, a pothole on a Dresden East street was the county’s to answer for, on a twelve-month clock. Today the same pothole belongs to the City of Chamblee, on six. Nothing about the street changed. The government responsible for it did, and the clock went with it. The airport runs the other way. It sits inside the city but belongs to the county, so a claim about airport property may stay on the county’s twelve months even though the sign at the gate says Chamblee. The clock follows who was responsible for that spot, not the name on your mail.

Who has your crash report in Chamblee?

Inside the city limits, Chamblee Police work the crash and keep the report at headquarters on Buford Highway. West of Chamblee Dunwoody Road, it’s Brookhaven Police. In unincorporated pockets with a Chamblee address, DeKalb County Police respond. State troopers work many crashes on I-85, I-285, Buford Highway and Peachtree Boulevard. The officer’s card tells you which agency it was.
