Hurt on Scott Boulevard, Ponce de Leon Avenue or Candler Road? Which side of that line you were on decides who wrote your report and how long you have. Our Atlanta office handles these cases. Zero fee unless we win.

AFTER THE ACCIDENT

Hurt on Scott Boulevard, Ponce de Leon or near the square?

Decatur has been the county seat of DeKalb County since 1823, when the state picked this spot for a courthouse before the town existed. That is why the DeKalb County courthouse stands at 556 North McDonough Street, a block off the square, with the old courthouse still in the middle of it. Here is the part that trips people up. The City of Decatur is small, about four square miles and about 25,000 people. The county courthouse, the county police headquarters and the county jail all carry Decatur addresses, and so do tens of thousands of homes that are not inside the city at all.

Maybe someone ran the light where Clairemont Avenue meets Ponce de Leon. Maybe a driver drifted across the center line on Scott Boulevard, or a car pulled out in front of you on Candler Road south of the city. Now you’re sore, your car is in a tow yard and an adjuster wants a recorded statement. That’s a lot to carry, and none of it is yours to sort out alone. Not sure whether you were inside the city? Our Atlanta office takes Decatur cases and can work it out from a street name or a landmark.

Don’t sign anything an insurance company sends you, whether it’s a statement, a medical release or a check, before you’ve talked with an attorney.

So “my case is in Decatur” can mean two different things. If you were hurt inside the city, Decatur Police and the City of Decatur are involved. If you were hurt at a Decatur address outside the limits, the county is. Either way, a lawsuit will probably be filed at the courthouse downtown, because that building belongs to DeKalb County, not to the city. The city’s own court, Decatur Municipal Court on West Trinity Place, handles traffic tickets written by Decatur officers. It does not decide your injury claim, though a ticket the other driver got can still help show who caused the crash.

The city offers its own rule of thumb: if your ZIP code is anything other than 30030, or your street number has four digits, there’s a fair chance you are not in the city. For how the county side works, read about DeKalb County deadlines for Decatur crashes.

Car and truck accidents in Decatur

Most Decatur crashes happen on a short list of roads: Scott Boulevard, Ponce de Leon Avenue, College Avenue, Clairemont Avenue, Commerce Drive, Church Street, North Decatur Road and Candler Road. Several are state routes where commuters, delivery vans and freight trucks share the lanes every day, and that mix of drivers can change who may be responsible for your injuries.

A wreck with a delivery van, a box truck or a rideshare driver can bring a commercial policy and an employer into the claim. We start by finding every policy behind car wreck claims in Decatur. If a tractor-trailer hit you on Scott Boulevard or out on the Stone Mountain Freeway, read how we handle Decatur truck crashes. Were you on a motorcycle? Our page for riders hurt in Decatur explains what changes when you were on two wheels.

Downtown Decatur is built for walking. The square, the MARTA station and the restaurants along Ponce de Leon and Church Street fill the crosswalks every evening, and farther out people cross Candler Road and Memorial Drive on foot far from a signal. When a car hits someone walking, the other side is quick to blame the person on foot. If that happened to you, read about pedestrians hit in Decatur.

Falls, dog bites and workplace injuries in Decatur

Falls in stores and parking lots, dog bites and injuries at work happen across Decatur, from the shops on the square to the hospital on North Decatur Road and the strip centers on Candler Road. Who owned or controlled the spot where you were hurt decides how the claim works, and if a government owned it, the rules get stricter.

If you slipped on a wet floor or tripped on a broken curb in a parking lot, our page on Decatur slip and fall claims explains what an owner had to know. Hurt on the job? Workers’ comp has its own forms and deadlines, and our workers’ comp help for Decatur workers walks through them. If you fell on a sidewalk around the square or in a county building, call us early. The city and the county are different governments with different notice rules, and some claims against them are limited by law.

Serious injuries and wrongful death

A serious wreck on Scott Boulevard or I-285 east of Decatur can change a family’s life in one afternoon. When a crash causes a brain injury, a spinal injury or a death, the claim has to cover years of care and lost income. Early offers arrive before anyone knows those costs, so these cases need careful work from day one.

If your family lost someone, read about wrongful death claims after a Decatur crash. If the harm happened during treatment afterward, our page on when hospital care after a Decatur wreck makes things worse explains the extra steps Georgia requires. Kenneth S. Nugent, P.C. has helped injured Georgians since 1980. You pay nothing up front, and there’s zero fee unless we win.

How long do you have to file a claim in Decatur?

A claim against a driver or a business in Georgia generally has a two-year deadline to file suit. If a government played a part, written notice can be due much sooner. For the City of Decatur, that’s generally six months. For DeKalb County or the state, it’s generally twelve months. Which one applies depends on exactly where you were.

Who you’re claiming againstWhat usually comes firstHow long, generally
The driver, or the company the driver worked forA claim with their insurer, then a lawsuit if neededTwo years to file suit, under O.C.G.A. § 9-3-33
The City of DecaturA written ante litem notice to the citySix months, under O.C.G.A. § 36-33-5
The City of Atlanta, on the Kirkwood, Lake Claire or Emory sideA written ante litem notice to that citySix months, under O.C.G.A. § 36-33-5
DeKalb County, for an unincorporated area with a Decatur addressA written notice to the countyTwelve months, under O.C.G.A. § 36-11-1
The State of Georgia, for a defect on a state route such as Scott Boulevard or College AvenueA written ante litem notice to the stateTwelve months, under O.C.G.A. § 50-21-26

Ante litem is Latin for “before the lawsuit.” It’s a letter a government must get before it can be sued. In DeKalb the question is rarely which courthouse, because almost every DeKalb lawsuit goes to the same one downtown. The question is which government. A pothole on a side street in Oakhurst is the city’s to answer for, on a six-month clock. The same pothole a mile south, on a street with a Decatur mailing address, is the county’s, on twelve. The clock follows where you were hurt and who was responsible for that spot, not the name on your mail.

Who has your crash report in Decatur?

Inside the city limits, Decatur Police work the crash and keep the report at headquarters on West Trinity Place. At Decatur addresses outside the limits, DeKalb County Police respond. West of the city, in Kirkwood or around Emory, it’s Atlanta Police. State troopers work some crashes on state routes and I-285. The officer’s card tells you which agency it was.

Decatur Police sell accident reports for $5 in person at 420 West Trinity Place, and the department also offers them through its online records portal and BuyCrash. The city asks you to confirm the address was inside Decatur before you file a request, and that is good advice: if it wasn’t, the county has the report.
