Hurt on Lawrenceville Highway, Hugh Howell Road or near Northlake?
Tucker voted to become a city in November 2015 and started running as one in 2016. About 37,000 people live there. The city has a mayor, a council, its own parks and, since July 2023, its own public works department for the roads. What it doesn’t have is a police department. DeKalb County Police patrol Tucker, and the county’s police headquarters sits right here, off Northlake Parkway.
That split is what people get wrong. In most cities, the officer who comes to your crash works for the same government that owns the street. In Tucker they don’t. A pothole or a dead signal on a city street is generally Tucker’s to answer for. A crash with the patrol car that came to work your wreck is generally DeKalb County’s. Different governments, different clocks. And a Tucker mailing address reaches past the city, even across the line into Gwinnett County. Maybe someone pulled out of a shopping center on Lawrenceville Highway, or ran the light at Hugh Howell Road. Now you’re sore and an adjuster wants a statement. Our Atlanta office handles Tucker cases and can sort out whose ground you were on.
Don’t sign anything an insurance company sends you, whether it’s a statement, a medical release or a check, before you’ve talked with an attorney.
| Where it happened | Whose ground it is | What that can mean for you |
|---|---|---|
| Main Street, LaVista Road, Mountain Industrial Boulevard and the city streets around them | The City of Tucker, in DeKalb County | DeKalb County Police write the report. A claim against the city for a road problem runs on a six-month notice clock. |
| A crash involving the police car that responded | DeKalb County, which employs the officers | The county’s twelve-month clock, not the city’s six |
| Lawrenceville Highway and other state routes | Inside the city, on a state highway | A county officer or a state trooper writes the report. A defect in the road itself points to the state. |
| Northeast across the Gwinnett County line, even with a Tucker address | Gwinnett County | Gwinnett police, Gwinnett courts and different deadlines. Call us and we will sort it out. |
| A lawsuit over any of these | Usually tied to who you sue and where they are based | Often the State Court of DeKalb County, in Decatur |
One more thing is moving. On November 3, 2026, voters in an unincorporated area next to Tucker decide whether to join the city. If they say yes, the city line moves, and so does the answer for crashes there. For how the county side works, read about DeKalb County rules for Tucker crashes.
Car and truck accidents in Tucker
Most Tucker crashes happen on Lawrenceville Highway, Hugh Howell Road, LaVista Road, Mountain Industrial Boulevard and Northlake Parkway, and on I-285 along the west side near Northlake. Lawrenceville Highway is lined with shopping centers and turn lanes, and drivers pulling in and out of them cause a lot of what we see.
A wreck with a delivery van, a box truck or a rideshare driver can bring a commercial policy and an employer into the claim. We start by finding every policy behind car wreck claims in Tucker. Mountain Industrial Boulevard is lined with warehouses and freight yards, so if a tractor-trailer hit you there, read how we handle Tucker truck crashes. Riding a motorcycle? Our page for riders hurt in Tucker explains what changes on two wheels.
Lawrenceville Highway is wide and busy, and people on foot cross it between bus stops, apartments and stores. If a car hit you or someone you love walking, read about pedestrians hit in Tucker. The other side is quick to blame the person walking. We are not.
Falls, dog bites and workplace injuries in Tucker
Falls in stores and restaurants, dog bites and injuries at work happen all over Tucker, from the shops on Main Street and Lawrenceville Highway to the warehouses along Mountain Industrial Boulevard. Who owned or controlled the spot where you were hurt decides how the claim works, and if a government owned it, the rules get stricter.
If you slipped on a wet floor or tripped in a parking lot, our page on Tucker slip and fall claims explains what an owner had to know. Hurt on the job in a warehouse or on a loading dock? Workers’ comp has its own forms and deadlines, and our workers’ comp help for Tucker workers walks through them. A fall on a city sidewalk or in a city park puts Tucker’s short notice clock in play. Some claims against governments are limited by law.
Serious injuries and wrongful death
A serious wreck on I-285 or Lawrenceville Highway can change a family’s life in one afternoon. Tucker has no trauma center of its own, so the worst injuries ride to a designated trauma center elsewhere in the metro, often Grady downtown. A brain injury, a spinal injury or a death means years of care to pay for.
Early offers arrive before anyone knows those costs. If your family lost someone, read about wrongful death claims after a Tucker crash. If the harm happened during treatment afterward, our page on when hospital care after a Tucker wreck makes things worse explains the extra steps Georgia requires. Our guide to trauma care after a Tucker crash explains where the ambulance goes and why. Kenneth S. Nugent, P.C. has helped injured Georgians since 1980. How long do you have to file a claim in Tucker?
A claim against a driver or a business in Georgia generally has a two-year deadline to file suit. If a government played a part, written notice can be due much sooner. For the City of Tucker, that’s generally six months. For DeKalb County or the state, generally twelve. In Tucker, one crash can involve both.
| Who you’re claiming against | What usually comes first | How long, generally |
|---|---|---|
| The driver, or the company the driver worked for | A claim with their insurer, then a lawsuit if needed | Two years to file suit, under O.C.G.A. § 9-3-33 |
| The City of Tucker, for a city street, sidewalk or park | A written ante litem notice to the city | Six months, under O.C.G.A. § 36-33-5 |
| DeKalb County, including a county police car | A written notice to the county | Twelve months, under O.C.G.A. § 36-11-1 |
| Gwinnett County, for a crash across the line | A written notice to that county | Twelve months, under O.C.G.A. § 36-11-1 |
| The State of Georgia, for a defect on I-285 or Lawrenceville Highway | A written ante litem notice to the state | Twelve months, under O.C.G.A. § 50-21-26 |
Ante litem is Latin for “before the lawsuit.” It’s a letter a government must get before it can be sued. Here’s the Tucker twist. Before July 2023, a pothole on a Tucker street was DeKalb County’s to answer for, on twelve months. Since the city took over its roads, it’s generally the city’s, on six. The police didn’t change hands, so a crash with a patrol car still points to the county.

Who has your crash report in Tucker?
Inside Tucker, DeKalb County Police answer calls and write crash reports, because the city has no police department. Across the Gwinnett line, Gwinnett police do. On I-285 it may be a county officer or a Georgia State Patrol trooper. Check the agency printed on the officer’s card, since it will say DeKalb, not Tucker.
| Where it happened | Who usually responds | Who to ask for the report |
|---|---|---|
| Anywhere inside Tucker | DeKalb County Police | DeKalb County Police records |
| I-285 near Northlake | A DeKalb County officer or a Georgia State Patrol trooper | The agency named on the officer’s card |
| Across the Gwinnett line | Gwinnett police | The Gwinnett agency named on the card. Call us and we will find it. |
| A MARTA bus | The police agency for that spot, and MARTA has its own police | That agency for the report, and MARTA to notify |
Because the report says DeKalb County, people sometimes assume the county is responsible for the road too. Since 2023 that’s often not true in Tucker. Tickets written here go through DeKalb’s courts rather than a Tucker municipal court, and either way that court doesn’t decide your injury claim. Lost the card? Our crash report help for Tucker drivers walks through each agency and what to bring.
