Which government runs the place where you were hurt?

Columbia County has only two incorporated cities, Grovetown and Harlem. Everywhere else, including Evans, Martinez and Appling, is unincorporated county. That one fact decides a lot: who writes your crash report, which government a claim runs against, and whether the notice deadline is generally six months or twelve.

Most people don’t know whether they live or drive in a city or in the county. There’s no reason they should. Mailing addresses say Evans or Martinez whether you’re in a city or not, and road signs don’t warn you when you cross a line. After a crash, though, the difference can matter a great deal.

Don’t sign anything an insurance company or a county office sends you before a lawyer has checked which rules apply. It only takes one call.

A claim against a private driver or business generally allows two years to file suit, wherever the crash happened. The tighter deadlines above only come into play when a government, its vehicle, its employee or its road had a part in what happened. For Grovetown specifics, see our Grovetown page. How do you get a report from the Columbia County Sheriff?

The Columbia County Sheriff’s Office takes crash report requests through the county’s open records portal, by email and in person at its offices in Evans and Appling. It asks for a short Statement of Need form with the request. Having the date, the location and a report number, if you got one, makes it faster.

The sheriff’s office also runs an online Police2Citizen portal. We haven’t listed fees or turnaround times here because they can change, and the sheriff’s office is the best place to confirm them. If you’d rather not deal with any of it, tell us the road and the date and we’ll request the report for you.

Crashes inside Grovetown and Harlem are usually handled by those cities’ own departments, so start there if a city officer came to the scene. On I-20, the Georgia State Patrol often works the crash. Which court hears a Columbia County case?

Since July 2021, Columbia County has been its own judicial circuit, the Columbia Judicial Circuit. Before that, it shared the Augusta Judicial Circuit with Richmond and Burke counties. The Georgia Supreme Court upheld the split in 2022. Columbia County cases are now heard at the Columbia County Justice Center in Evans.

The Justice Center, on Ronald Reagan Drive, houses the county’s Superior Court and Magistrate Court, along with its Probate and Juvenile courts. Which court fits an injury case depends on the claim and its size, and we’ll explain that before anything is filed.

Where a case is filed also depends on who you’re suing. A lawsuit is usually filed where the at-fault driver lives, not where you live or where the crash happened. So a crash in Evans with a driver from Augusta may end up in Richmond County. If that’s your situation, see Richmond County’s courts and deadlines.

The difference between a six-month deadline and a twelve-month one is the difference between a claim you can still bring and one you can’t. What to do this week

A few small steps now can protect your claim later. None of them require talking to the other driver’s insurance company, and none of them require you to understand county lines. If you’re still healing, do the first two and let us handle the rest.

1. Write down exactly where the crash happened, with the nearest cross street.
2. Note which agency came to the scene: the sheriff, a city department or the State Patrol.
3. Request the crash report, or ask us to request it.
4. Keep any letters from a county or city office, and don’t sign them yet.
5. If a government vehicle or road was involved, call us before month four.

Terms you’ll see in a Columbia County claim

Unincorporated. Land that isn’t part of any city. In Columbia County, that includes Evans, Martinez and Appling.

Judicial circuit. The group of counties a set of Superior Court judges serves. Columbia County has had its own since 2021.

Statement of Need. A short form the sheriff’s office asks for with a records request.

Open records request. A written request for a public record, such as a crash report, from a government office.

County seat. Appling is Columbia County’s official seat, but most county offices and the courts work out of Evans.
