How long do you have to file a claim against Macon-Bibb?
If a Macon-Bibb County vehicle, employee or road played a part in your injury, you usually have to send the government a written notice before you can sue. No Georgia appeals court has settled whether Macon-Bibb gets the six-month city deadline or the twelve-month county one. The safe plan is six months from the day you were hurt.
That’s not the kind of thing anyone should have to figure out from a hospital bed. Kenneth S. Nugent, P.C. handles claims against governments all over Georgia, and we can tell you in one phone call which clock you’re probably on. There’s zero fee unless we win.
Don’t sign anything a government’s insurer or claims office sends you before a lawyer has looked at it. Some of those forms close doors you’ll want open later.
Deadlines at a glance for a Bibb County injury
| Who caused the harm | What you have to do | How long | Law |
|---|---|---|---|
| Macon-Bibb County (a county vehicle or employee, a county road) | Send written notice first | Plan on 6 months. It may be 12, but no appeals court has said so for Macon-Bibb. | O.C.G.A. § 36-33-5 or § 36-11-1 |
| The State of Georgia or GDOT (I-75, I-16, I-475, state highways) | Send written notice first | Generally 12 months | O.C.G.A. § 50-21-26 |
| A federal vehicle or employee | File a written claim with the agency | Generally 2 years | 28 U.S.C. § 2401(b) |
| A private driver, trucking company or business | File a lawsuit | Generally 2 years | O.C.G.A. § 9-3-33 |
Georgia gives cities six months and counties twelve. Macon-Bibb is both at once, and the statutes were written before consolidated governments like it existed. In a 2014 case about Athens-Clarke County, another consolidated government, the Court of Appeals applied the county deadline. It didn’t explain whether that choice was required, and no court has ruled on Macon-Bibb. So the honest answer is that nobody can promise you twelve months.
The notice itself has rules too. It generally has to say when and where you were hurt, what happened and what you’re asking for, and it has to reach the right office. A letter that’s late, vague or sent to the wrong place can sink a claim that was otherwise strong.
Other public bodies in the county can raise their own questions. The Macon-Bibb County Transit Authority, which runs the city buses, is a separate public authority. If a bus was involved, call us before you assume any deadline.
Was a county truck, a deputy’s car or a bus involved? Call 478-295-5765 this week. Six months goes by faster than it sounds when you’re in physical therapy.
Which court hears a Macon injury case?
Most injury lawsuits from Bibb County crashes are filed in the State Court of Bibb County or the Superior Court of Bibb County. Both sit in the courthouse at 601 Mulberry Street, a short walk from our office. The Superior Court judges serve the Macon Judicial Circuit, which covers Bibb, Crawford and Peach counties.
| Court | What it usually handles | Where |
|---|---|---|
| State Court of Bibb County | Many car crash and injury lawsuits, with a jury if the case goes to trial | 601 Mulberry Street |
| Superior Court of Bibb County | Injury lawsuits of any size, plus cases only a superior court can hear | 601 Mulberry Street |
| Civil and Magistrate Court of Macon-Bibb County | Smaller claims, such as a property damage dispute | 601 Mulberry Street, 4th floor |
Where a case gets filed isn’t always up to the place you were hurt. It often depends on where the person or company you’re suing lives or does business. A Macon crash with a driver from Warner Robins, for example, may end up in Houston County’s courts in Perry. We’ll explain the options and pick the one that serves you best.
Our car accident attorneys file in these courts regularly. So do our premises liability lawyers, whose cases sometimes involve a fall on public property, and our wrongful death attorneys, whose deadlines follow their own rules.
Why Macon-Bibb is a special case
Before 2014, Macon was a city and Bibb County was a county, each with its own government, police and claims office. On January 1, 2014, they became one government. Payne City, the last small town inside the county, was dissolved in 2015. Today there’s one local government for every road in Bibb County.
That makes some things simpler. There’s one claims process and one sheriff’s office, and our Macon-Bibb crash report guide explains how to get the report. But it makes the deadline question harder, because the law still treats cities and counties differently. Plenty of people here still think of “the city” and “the county” as separate, and that habit can lead to sending notice to the wrong place.
If you were hurt outside Bibb County, the rules change again. Houston County is its own circuit with its own courthouse, and our page on Warner Robins claim deadlines walks through that county’s clocks.
Legal terms, in plain English
| Term | What it means |
|---|---|
| Ante litem notice | Latin for “before the suit.” A letter you must send a government before you’re allowed to sue it. |
| Statute of limitations | The deadline to file a lawsuit. For most Georgia injury claims, it’s generally two years. |
| Sovereign immunity | The rule that governments can’t be sued unless the law makes an exception. The notice rules are part of those exceptions. |
| Venue | Which county’s court a case is filed in. It usually follows where the defendant lives or does business. |
| State Court | A county-level trial court that hears many civil lawsuits, including a lot of car crash cases. |
What to do this week
- Write down the date. Every clock on this page starts the day you were hurt.
- Note any government connection. A marked vehicle, a uniformed driver, a pothole or a broken signal can all point to a government claim.
- Keep your paperwork. Medical bills, the crash report number and any letters from insurers all help.
- Call before six months, not after. We’d rather hear from you early and tell you there’s plenty of time.
You can reach our Mulberry Street office any time, day or night. If you’re too hurt to come downtown, we’ll come to you.
