Byron sits in three counties
Most of Byron is in Peach County. Small pieces reach into Houston and Crawford counties too. That sounds like trivia, but it matters once you’re hurt, because the county where the crash happened decides which sheriff may have the report, which courthouse may hear the case and which county deadline applies if a government vehicle was involved.
You don’t have to work any of that out yourself. Kenneth S. Nugent, P.C. handles Byron injury cases from Kenneth S. Nugent’s Macon office, about 20 minutes up I-75. Across Georgia we’ve recovered more than $5 billion for over 300,000 clients in 45 years, from 9 offices, and there’s zero fee unless we win.
Don’t sign anything from an insurance company before a lawyer has looked it over. What they call a routine form is often a release.
How long do you have to file a claim in Byron?
Most Georgia injury claims must be filed within two years. If a government was involved, you usually have to send written notice first. A City of Byron vehicle generally means six months. Peach County, or Houston or Crawford County if the crash was on their side, generally means twelve. The State generally means twelve.
That written notice is called an ante litem notice, from the Latin for “before the suit.” It’s a letter the government must receive before you can sue. If it’s late or goes to the wrong county, the claim against that government can be lost.
| Who caused the harm | Deadline | Law |
|---|---|---|
| City of Byron (a city vehicle, employee or city street) | Generally 6 months to send notice | O.C.G.A. § 36-33-5 |
| Peach County, or Houston or Crawford County depending on the location | Generally 12 months to send notice | O.C.G.A. § 36-11-1 |
| The State of Georgia or GDOT (I-75, Highway 49, the Fall Line Freeway, the 247 Connector) | Generally 12 months to send notice | O.C.G.A. § 50-21-26 |
| A private driver, trucking company or business | Generally 2 years to file suit | O.C.G.A. § 9-3-33 |
Not sure which county you were in? Call 478-295-5765. Give us the road and the nearest landmark, and we’ll figure it out.
One more wrinkle: a Byron police car and a Peach County sheriff’s cruiser can look alike in a rearview mirror, but the clocks are different. Six months for the city, generally twelve for the county. When we aren’t sure yet, we plan around the shorter one.
Car and truck crashes in Byron
Byron’s main I-75 exit is exit 149, where Highway 49 and the Fall Line Freeway head west toward Fort Valley and Columbus. Exit 146, the Highway 247 Connector, leads east toward Centerville and Warner Robins. Both interchanges mix interstate traffic, trucks and local drivers. Our Peach County car crash attorneys can take it from here.
Freight moves through here all day, between Atlanta, Florida and the routes west. If a big rig hit you, our tractor-trailer accident lawyers send preservation letters quickly, because a truck’s logs and camera footage can be erased. Riders hurt on the two-lane roads around town can talk to our motorcycle wreck attorneys.
Byron also sees a lot of out-of-town drivers stopping for gas and food between Atlanta and Florida. A crash with a driver from another state is still handled under Georgia law when it happens here, and their insurer still has to answer for it. We deal with out-of-state insurance companies all the time.
Byron is also a short drive from Robins Air Force Base. If a base vehicle or a federal employee on duty was involved, different rules apply, and our page on base-related crash claims explains them.
Falls and workplace injuries in Byron
If you fell in a store, a restaurant or an apartment complex, the owner may be responsible if they knew about the hazard and didn’t fix it or warn you. Our slip-and-fall lawyers will tell you honestly whether it’s a case, and the call costs nothing.
If a dog bit you or your child, we can explain what Georgia expects from the owner. If you were hurt at work, in a warehouse, on a farm or on the road, our on-the-job injury lawyers can explain whether workers’ comp is your only claim, or whether a third party, like a delivery driver or equipment maker, also owes you.
Serious injuries and wrongful death
Byron has its own emergency room at Atrium Health Navicent Peach, off the Highway 247 Connector. The hospital moved there from Fort Valley in 2012. For the most serious injuries, patients are often taken on to the Level I trauma center in Macon, and our guide to Middle Georgia trauma care explains why.
When a crash causes a brain injury or takes a life, the claim has to reach years ahead. Our brain injury attorneys work with treating doctors from the start. If you’ve lost someone, our wrongful death attorneys will explain who can bring the claim and what it covers.
Who has your crash report in Byron?
Inside Byron city limits, the Byron Police Department usually writes the report. Outside the city, it depends on the county: the Peach County Sheriff’s Office in most of the area, or the Houston or Crawford County sheriff on their sides of the line. On I-75, troopers from the Georgia State Patrol post in Perry often respond.
| Where the crash happened | Who usually has your report |
|---|---|
| Inside Byron city limits | Byron Police Department |
| Unincorporated Peach County | Peach County Sheriff’s Office |
| The Houston or Crawford County side of the line | That county’s sheriff’s office |
| I-75 or a state route where a trooper worked the scene | Georgia State Patrol, Post 15 in Perry |
Tell us where it happened and we’ll request the report for you. The diagram, any citations and the witness list often shape what the insurer offers before anyone has heard your side.
Where a Byron case is heard, and getting to us
Peach County is part of the Macon Judicial Circuit, the same circuit as Bibb and Crawford counties. Its courthouse is in Fort Valley, the county seat. Peach County doesn’t have a State Court, so a local injury suit generally goes to Superior Court.
A case on the Houston County side may be heard in Perry instead. And because Peach and Bibb share a circuit, the same Superior Court judges who sit in Macon also hear Peach County cases. It’s about 20 minutes up I-75 to our Macon office. For how deadlines work when a Macon-Bibb vehicle is involved, see our guide to Bibb County claim deadlines. And if you can’t drive, we’ll come to you.
