Technical Errors Errors that occur during the course of a trial but have not affected the losing party so that, if appealed, a reversal would be groundless.
Temporary Injunction Any action that is prohibited in the short-term by a court order, until another trial or court action has been taken.
Testify When an individual verbally gives evidence under oath in a court trial or deposition, that individual is testifying. Witnesses who testify are asked questions by the both the plaintiff's and defendant's attorneys.
Testimony This is the verbal evidence given under oath by the witness who testifies.
Third Party In a contract or transaction, a third-party is not a direct party of the contract, but has an indirect involvement.
Third Party Benefits In insurance law, third party benefits refer to the amount of available coverage that the at-fault party has in bodily injury and property damage.
Third Party Lawsuit When a individual is injured on the job due to the omission or negligence of a party other than his or her employer, this person can file a third party lawsuit.
Tipstaff A tipstaff is a bailiff, an officer of the court who assists and runs errands for the judge within the courtroom.
To Wit Used within legal documents, "to wit" means, "that is to say."
Total Disability Total disability is a type of worker's compensation that is issued when an injured employee is totally impaired from normal functionality due to a work-related injury.
Tort Based on the French word for "wrong," a tort is any intentionally or accidentally wrongful act that results in injury to another person, and includes acts negligence or omission.
Tort Claims Act Though certain individuals or entities might have governmental immunity from lawsuits based on injury through harmful acts, the Tort Claims Act makes it possible for the federal government or certain states to waive that immunity. This means that the injured individuals may be able to make claims of negligence, intent to harm and omission of those with immunity.
Tortfeasor One who who commits a civil wrong, whether it is intentionally or through negligence.
Tortious Tortious is an adjective to describe an act which is a civil wrong, or tort.
Transcript All court proceedings in a trial, including the testimonies are recorded in a document called a transcript.
Transferred Intent When an individual intends to harm one person and instead harms someone different from the target, by law, the intent is transferred to the targeted victim.
Trespass Causing any amount of damage to an individual's property by entering without an invitation by the owner. This is a tort, or civil wrong.
Trespasser A trespasser is the individual who enters land without the owner's permission.
Trial Any examination of facts to determine an outcome, judged by an individual with the legal authority to do so.
Trial Calendar List of trial dates and involved parties maintained by the clerk of court or the trial judge of cases awaiting trial.
Trial Court The first court to hold a trial for specific individuals involved in a specific matter. This is not to be confused with an appeals court, which reviews the case after it has already been tried.
Trier of Fact In a trial with a jury, the jury decides factual issues and are the trier of fact. In a trial without a jury, the judge takes on these responsibilities and becomes both the trier of fact and the trier of law.
